Physical Disability Board of Review Update

I got my retirement orders this morning in an email from Ft Leonard Wood. Glad that done. The distribution list includes DFAS so they should be getting a copy as well.


Congratulations!!!!!! I just got a call from a nice lady from the National Guard Bureau this morning who is trying to get my orders cut by Fort Bliss. Seems my being in the USAR retired control group (awaiting pay at age 60) and having previously been in the National Guard and not having taken severance pay is causing everyone fits in trying to get my paperwork done.

At least it seems they are back to work in the DC / Virginia area :)

Send a letter to the VA asking them to audit your account. I did that a couple of years ago and it took awhile but they sent me a full audit of what they have paid me over the years. It was very thorough.

To tell you the truth I don't know. No one in all the various agencies / people I have worked with can tell me. I believe my retirement orders will be retroactive to June 2002 (PDBR Memo says it should). However DFAS threatens to impose a six year statute of limitations on my back pay. Jason thinks (and I agree) that it should not apply to PDBR actions.

I will let you know as soon as I know, but that appears to still be some indefinite point in the future. I am hoping I will know by the middle of next month, but I am purely guessing there. Esssentially I will know when I get my orders and DFAS issues the back pay check.

Also the VA just upgraded me to 60% disability from 40% this week. (Based on a shoulder injury they missed when I was separated). I am hoping DFAS does not apply my 60% retroactively to June 2002 when figuring back pay. I did not take severance pay, so VA should be all they deduct from my back pay.

By the way, do you know if I can get some kind of accounting sheet from the VA detailing what they have paid me since June 2002?

I was retired last month, I submitted my paperwork for Survivors Benefit Program, I have not heard anything in a month... I have no clue how long it will take until I get my retirement orders or DD 214... However people, I have good news, I really wanted my Tricare benefit so I made a couple of phone calls. I called the PDBR board "Intake Unit" the supervisor there had contacted DEERS for me and DEERS updated the system to reflect that I was retired! I went and got a retired ID card without retirement orders because the system reflects that I am retired. I am still waiting for everything else but at least I have what is important"TRICARE"! I hope that this helps people receive their TRICARE and retired ID card. I dont see why it wouldnt work for you if all that I did was ask the PDBR to contact DEERS and asked them to update the system.. GOOD LUCK

Thanks for the advice I will do that. I knew they must have a method for doing that, I just could not find it on the VA web site.

The PDBR updating DEERs in the manner you stated would work just as you indicated, my only question is if those knuckle heads had the authority to modify the DEERs data base, then why don't they just do it for EVERYONE as a matter of routine. It takes all of 2 minutes if you have terminal access.......arghhhhh

hey guntruck hammer, whats Mrs Preston phone number at Army Disability agency?because i i cant seem to get no where since i recieve PDBR letter informing me of retirement, which was way back in oct of 09.
 
Has anyone got an answer to my earlier post about "If you were separated with severance pay you only get a move to you HOR (Home of Record)" ,most of us probably made that move. But, once your medical retirement is granted retroactive to the day of you original discharge doesn't that in itself constitute another move anywhere just as if you were medically retired from day one The burden of proof and blame is place back on DOD who grants the entitlement, why should we lose and suffer of their lack of understand of their own regulations. All of you guys who where granted retirement status should band together and ask those hard question I'm sure they never thought about.

I hope like heck you can move anywhere you COULD HAVE MOVED if they would have adjudged you correctly THE FIRST TIME!

Since they are NOT paying interest on their "OOPS"!, this is the least they can do to set you right on course - AS IT OUGHT OT HAVE BEEN THE FIRST TIME OUT!

Thanks for bringing that up. After my medical discharge. The Army stored my household goods for 6 months, but by that time I still hadn't figured out what to do, so I ended up storing on my dime for another two years. Now that I got retired I'm moving into a house so It would be nice to have some help with the move. Especialy since some of my stuff is 2000 miles away.
 
I called DEERS yesterday. There wasnt anything they could do over the phone. I have to go in person with my orders to update DEERS and tricare. I live in Missouri and the closest place for me is Rock Island IL. About a 3 hour drive.

I have an appointment march 2nd in Rock Island IL to get my ID card and get my family enrolled in DEERS again. Glad for that
 
HERE WE GO AGAIN!

Well a quick review. I was discharged on 24 June 2002 with 10% disability and discharged from Active Duty and returned to the Florida Army National Guard. I refused severance pay and instead opted for transfer to the USAR- Retired control group awaiting my retired reserve pay at age 60. It took the Guard until 31 DEC 2002 to finally get me transferred to the USAR-Retired control group.

Fast forward to today. I finally got a copy of my orders. And of course they state my effective retirement date as, can you guess? Yup, 31 DEC 2002. You see if the Army had retired me at 30% disability, like the PDBR said they should have. Then I would have been retired on 24 June 2002, and I never would have returned to the Guard system.

I just re-read my board paperwork and it seems the PDBR said my retirement should have been effective on my original discharge from active duty (June 2002). However the Army Review Board Memo attached says my retirement should be effective on my transfer date to the USAR.

Any Idea's anyone?????? I am really exhausted with all this about now.....Seems I will get cheated out of 6 months of back pay at least.....
 
Went to Rock Island Arsenal to get my retirement ID card. Almost a 3 hour drive. The people there were very helpful. The lady doing my ID and updating my DEERS said that the orders I have are only for the 6 month TDRL and that I need to get a copy of the permanent PDRL orders. Don'y know if those have been done. Sent an email to Ft Leonard Wood to the woman that made the first set of orders asking about the PDRL orders. Hopefully will get a response soon.

Change 20: I went to arrange my move yesterday since moving told me over a week ago that my move was reset. (Sounds of screeching halt), now there not sure as I’m committed to the move. Then I found out my retirement order were just my Medical discharge orders with just the date changed and retirement put in. Has anyone else seen problems with this stuff?

Have you ever represented a Coast Guard veteran before? I haven't found any Coasties who have applied to the PDBR. They probably don't know about it.
 
At the PDBR? No, I have only represented Coasties at the PEB. I suspect that you are right, most don't know about it. In fact, I would say that most probably do not know about it.
 
Thanks for the reply Jason. If the PDBR comes back and does not give me what I think the overwhelming evidence states I should get...30% or more Ch 61 retirement, can i file a federal lawsuit? I have the money and was curious if this would be worth the effort.
