PLACED ON TDRL for 6 months at 50% then dropped to the original 10%

I'm pissed!!! I sent in all info to the pdbr over a year ago. Today I recieved paperwork stating that i was retroactivly placed on the tdrl for ptsd. They gave me the 50% rating I was supposed to get 3 years ago for 6 months and then dropped my rating to the original 10% taking me off of the tdrl and DISCHARGED!!!! I spoke w/ the pdbr today from texas airforce base and they said they recommended I be placed on tdrl for 6 months at 50 then dropped to 30% placing me on the permantly retired list. They said that the SECRATARY OF THE NAVY rejected the recommendations set by them..

This was all the info i could get.. I dont UNDERSTAND what the point of this all was. I started at the ILLEGAL 10 percent when i was discharged and nothing has changed other than for those 6 months i was retroactivly placed on tdrl.... HAS ANYONE GONE THROUGH THIS!!??? What is the criteria that the sec of the navy used to drop my disability rating 40% in 6 months??? ANY HELP IS NEED AND APPRECIATED!! SEMPER....

How can the predicted future effects of PTSD be so drastically changed like that? Did you get re-evaluated?

§4.129 Mental disorders due to traumatic stress.

When a mental disorder that develops in service as a result of a highly stressful event is severe enough to bring about the veteran’s release from active military service, the rating agency shall assign an evaluation of not less than 50 percent and schedule an examination within the six month period following the veteran’s discharge to determine whether a change in evaluation is warranted. (Authority: 38 U.S.C. 1155)
 
No I was never re-evaluated!!! Again,, all they did was RETROACTIVILY change my discharge to temporarily retired for six months!!!! Something is REALLLY off w/ this!!!

Are rated right now by the VA for the condition they found unfitting? If so, what % does the VA have you rated at for that condition?

yes i am still at 30% disability from the va for ptsd.. have been since the day i got out in 2007
 
Wow, then you definately have a case. It doesn't make any sense. Somehow they are saying that you were fit for duty after six months, but I don't see how they can determine that without an evaluation. I wish I had advice for you, but I'm not sure what the procedure is for this. I'm sure LTcol parker will guide you through the process. Good luck and I hope you get the justice you deserve.
