I have the biggest brain fart right now and its bugging me. I have 2 profiles, a T3 and a P3 and my 1SG said that my T3 is not valid until my company commander signs the profile. He said that since my P3 is signed by 2 doctors then that is vaild. I thought that when the dr issues the profile it is vaild? Is my 1SG correct in this matter, if so or if not what reg covers this ?

Valid in what regard? All profiles are valid as long as the temporary is not expired... Did he mean something else?

He said " You know that this profile is not vaild until the commander signs it right", I guess basically he was getting at that he was not going to do what my profile says.

A T3 is a temporary profile issued by a doc. Those are usually reviewed by the division surgeon to determine if a T status is good, or if a P status needs to be assigned. Your commander doesn't "sign" a T3. Unless things have changed very recently. If Top orders your to break your profile, then it's your call. For me, I wouldn't do it, but I have "short timers syndrome".

I appreciate the responses, I think I am going to call my Nurse case manager tomorrow and let him know whats going on also.

Assuming you are Army..you will need to refer to AR 40-501. In this case you will need to pay attention to 7-6, 7-8, and 7-12.

Also, in the commanders eyes if you have a T3 it's more of a recommendation not a binding document. If a soldier has a t3 and there is a movement or deployment in the near term, they have overriding power and can say even though this guy has a t3 he/ she needs to be there etc.

As yardbirdaa said, if they tell you to break it you can chose to do what they ask or refuse. If you were to worsen the condition by doing what they ask then they will most likely receive a call from the Brigade Surgeon because the moment it gets worse you make sure everyone knows you were doing what you were told.

Just tread lightly on this and speak tactfully and professionally and read the regs and they shouldn't mess with you.

Only a foolish commander would order someone to violate/break a profile, temporary or permanent, because he/she is then fully responsible for what happens to you. If your injury/illness gets worse then that CDR will get relieved of duty. I've seen one get charged criminally for this as well.

On the old DA3349 (FEB 2004) there was a block for the Unit Commander to sign. The new one dated SEP 2010 does not have a place for the Unit Commander to sign unless they feel the need to sign the block for the approving authority. The profile is a recommendation from your physician, but as SGT Bob said a Commander would not think much of their career if they forced you to violate the profile.
