Question about CRSC

I apologize if this is in the wrong area, I wasn't sure where to post. Also, please bear with me as I'm having trouble finding my records and recalling from memory.

I was placed on PDRL Dec 20 with 90% DoD and 100% VA ratings. The biggest rating came from a combined psychological rating, including TBI and depression. When I went through the IDES process I was barely able to function at times. I struggled to perform basic tasks (hygiene, speaking, reasoning), it was bad. I barely remember the IDES process, but I remember being very confused about CRSC and the ratings. I still don't fully understand it (I understand what CRSC is, and that it's a separate application, that's about it). When I received my ratings, I remember there being 2 different sections regarding combat. One section was a yes and one was a no. If I'm remembering correctly, there was a specific "no" in regard to CRSC. I have 4 conditions which meet the requirements of eligibility for CRSC. I don't know if I got screwed during the IDES, or if I just need to do some work to either apply for CRSC, and/or appeal the PEB.

I'm trying to revisit this now that I'm a little better able to comprehend things, and I have some questions:

1. Is CRSC something that should normally be included in the IDES process, or is it normally applied for after separation?

2. Is there any point in pursuing this any further without evidence? I don't think I have paperwork on anything that would properly link the conditions to their combat related cause. I always tried to let things heal before going to sick call or role 1, and definitely never expected to be in this situation. If there is anything in my records, it would be a sick call note about me describing the injury.

3. Even if it would be worth pursuing the CRSC, would I be risking a potential reevaluation or reduction of ratings by doing so? Everything is still there, but the ratings I received were favorable. I'm concerned about opening a can of worms by initiating this process.

I don't know if anyone here has been through something similar, or has any advise, but I'll take anything I can get. I had dismissed the idea of CRSC (despite meeting the criteria on four conditions and knowing I should be eligible) until speaking to a friend recently who is CRDP. He referred me to this forum and encouraged me to pursue it. I am hoping I can find my records and provide better information here, but until then I'm looking for any and all guidance.

Thank you for whatever help you can offer.

Answers:
1. Most CRSC applications are submitted to the service concerned AFTER retirement. I have read that boards will not accept CRSC applications without the applicant being retired since retirement and waiver of retired pay are required.

2. Evidence of a nexus between the disability and combat related conditions are necessary. Exceptions: presumptively
“caused by“diseases/disabilities.

3. There is no penalty for filing a CRSC application.

Also recommend you go on to the DFAS page for CRSC. There is some good information there as well.

Good info.

Please note that the page I recommended has the following included:

I applied for CRSC recently and was approved. I am a Vet with 24 years of active duty and receive 30% disability which is offset against my retirement pay. Is my CRSC compensation added to my retirement pay or offset by the same amount I am getting for my disability?

Hello @mstuart104

Your CRSC replaces some or all of the retired pay you currently have offset, dollar for dollar in the amount of VA compensation received.

It is not retired pay; it is a special compensation.

You should receive from DFAS:
--retired pay minus amount of VA comp
--CRSC at the rate/percentage approved (amount found in VA comp tables)
plus
VA comp from the VA.

So, that CRSC comp is in addition to my retirement pay? So, my VA offset is $522 per month. Does CRSC reimburse me for the offset by adding $522 to my retirement pay?

In your case, yes. You situation:
You should receive from DFAS:
--retired pay minus amount of VA comp
and
--CRSC at the rate/percentage approved (amount found in VA comp tables)

Different case (mine):
Rated 100% by VA
Chose 100% CRSC over CRDP
Receive zero retired pay
Receive CRSC in the amount of what my retired pay would be.

Ron

Hello @mstuart104

You will receive two separate deposits from DFAS.

One: the residual retired pay after VA offset
Two: CRSC in the same amount of the VA offset IF the approved percentage is the same. If the approved CRSC is at a lesser percentage, you will receive that amount.

I remember that paperwork to that had yes and no. Almost all my conditions that i needed were marked yes. Except MDD which was caused by my chronic pain from back which was CRSC. But it was marked primary not secondary and lumped with tbi that wasn't CRSC. So I dont know where ima go from here.

Do you got an update?

Do you mean "combat-related" vs "CRSC"?

Oops yeah sorry about that. It was coded as combat related, I just can't find the document during my meb, I thought it was the 199 form but its not.

But yeah I'm going to apply for crsc, my DOD rating was 60% and all of the disabilities were Combat related, I wasn't found unfit for MDD, does MDD need to be unfit in order for it to be Calculated into CRSC. My concern is even if I can get it to be considered secondary to back injury will it even make a difference?

Also thank you so much for your reply and sorry I dont make sense sometimes.

All good :) For one thing, CRSC looks at the VA-rated conditions, not just for those that were referred.

Hello,

Good point.

Many CRSC recipients did not receive a disability retirement. I have received CRSC almost from the advent of the program and I had a regular (20 year +) retirement. The VA documents were the basis for the approval.
