question about length of process

Hello all. I have another question. I just received an email stating that my package has been received at HQ (ADM-1) I am wondering if anyone has an idea how long it takes to get a response once the package is received.

On a side note, when the narrative summary was written for my MEB, it was done for the severed nerve which occured during surgery, resulting in permanent dameg to my leg. The back had healed, but right after the MEB was sent, the disc re-ruptured in the same spot (L5-S1). The Medical Officer who initiated my board said that the narrative summary would not need to be updated to reflect the re-ruptured disc, since the MEB was being done for the nerve damage, not the actual back issue.

I actually did not realize I was into the IPEB phase. I thought the MEB was done, and was sent to HQ to determine if an IPEB is needed. Now I am thinking the IPEB should have ALL current medical status. Is this correct?

The waiting is the hardest part, so if anyone has an idea, how long I may have to wait from this point, I would appreciate it. Thanks!

Per DoD Instruction 1832.38, the PEB process (including IPEB and FPEB) should take not longer than 40 days.

I disagree with the Medical Officer.
According to COMDINST 1850.2D, Chapter 3, L, the following action should take place:

"L. Change in Evaluee’s Status or Physical Condition Prior to Final Action. When there is any significant change in the evaluee’s status or physical condition prior to final action, the evaluee’s CO shall notify CGPC-adm-1, and CGPC-epm/opm or the servicing ISC (pf) for reservists. The CO may make recommendations with respect to holding a case in abeyance."

Does your PEBLO know about this new injury? If your CO does not notify, you have to consider what action to take next. In my view it is required and very important that the IPEB have all information before it in a case that is likely to result in an "unfit" finding.

Sorry to hear about the injury. Please let us know any questions.

Jason; thanks for that. I remembered reading something along those line. It just makes sense to me for the Board to make a decision based off ALL information, not a 5 month old Medical report, that sat around for over 2 months collecting dust because someone, somewhere along the way dropped the ball. At any rate, I have been in contact with HQ, and I should be getting an answer in the next couple weeks. On a side note Jason, should the results come back rating me under 30%, I will be giving you a call to request your services. I probably should have done it months ago, but with only 2 weeks left, I will wait and see what the Informal comes up with.

Let's hope they do right by you and award 30% or greater.
