Re-Enlistment Requirement after Return To Duty?

Evening all,

Is anyone aware of the regulations that state that after a member is Returned to Service/Duty that if they are on an extension that they must re-enlist at that time???

Any help would be greatly appreciated,

Reenlistments are voluntary; one cannot be ordered to reenlist. Of course, the service member must fully qualify for reenlistment in order to do so.

A reenlistment or extension might be a requirement for eligibility for certain programs, but the choice remains with the service member if he/she is eligible.

I can’t answer your question directly. Years ago, one of my team members was put on TDRL, due to a traumatic brain injury (car accident). A couple of years later he was RTD and had to serve the rest of his enlistment, but not a new term of years.

Good example.

No one can be forced to reenlist.

So the problem I am having is that I was returned to duty last year, I'm trying to re-enlist right now and having a bunch of issues but it was mentioned that when I was RTS my extension should have ended and that FSS should have then told me about re-enlisting. Having said that, I am trying to use that as ammunition to re-enlist when they deny me.

Being returned to duty doesn’t automatically force a reenlistment, but if you were kept on an extension to get through the process they may require you to take action to regain retainability once you’re cleared. Basically the extension was temporary to cover the MEB window, and after RTD they want you either to reenlist or separate when that extension ends. It usually comes down to retainability rules and assignment eligibility, so MPF or your career advisor can show you exactly what applies in your case.
 
Reenlistment cannot be forced after RTD; extensions used during the process end, and any further service depends on the member’s retainability and eligibility, so reenlistment is optional but may be required to continue serving.
