Retired Pay Question

I received a registered letter from DFAS letting me know my retiree pay and that their findings are in my best interests. Bottom line is that they have my disability at 40% which was my DoD rating. Do I need to do anything once my IDES VA claim is finalized since it was proposed that my VA Rating is to be 70%?

Thanks

If DFAS calculated your retirement pay based on the wrong disability percentage, I would contact them to ensure VA and DFAS exchange the right disability percentage for the correct pay to take place the month following your retirement date.

With the information they have, it is currently correct. What I'm asking is once my VA claim is finalized now that I'm retired, do I need to get them my rating or does the VA talk with DFAS directly?

If the DoD has you at 40% and the VA at 70% (your timeline shows 80%) then it is more than likely that the DoD retirement pay will be slightly greater.

However, you will still get your VA C&P because it is tax free and that amount will be subtracted from your DoD retirement (which should be taxable unless your unfitting condition(s) are combat related or occurred in a combat zone.

If you have any condition(s) that are combat related, you should apply for CRSC to restore all or part of the VA offset to your DoD retirement.

Try asking your Wounded Warrior rep. I was wondering about this, too.

I mistakenly responded before. Now I see what you have asked, DFAS and VA do talk so you pay is correctly adjusted at either or both sides by means of audits. If you've already received the certified letter, that would be your DFAS pay.

Thank you. The 80% is a mistake on the VA's part and hopefully it will be fixed when my claim finalizes to the correct
70%. I submitted a statement to the VA explaining why my rating was incorrect prior to retiring in hopes of them fixing the rating mistake sooner than later. Also since I did more than 20 years I should eligible for CRDP, right?

I'm officially retired now but I also never had a Wounded Warrior rep.

I did receive my certified letter this past week, just waiting on the VA to finalize my claim.

Thank you all, I appreciate the responses.

What is this certified letter I keep hearing about?

If you did more than 20 years active duty time, you should be retired at 50+% and be eligible for CRDP. If you 20 years is a result of reserve time, then yo can collect the retirement at the age of 60 (or sooner if you qualify under the NDAA of 2008).

It comes from DFAS after you have retired. It explains your retirement pay, disability percentage and federal/state taxes.

Yes I did 20+ years of active time and pending my finalized VA claim I should be above 50%.

Thank you.

Ahhhh okay. Do they send it to the address that you have in DEERS?

No I believe they use the address you put on the DD 2256 when you are taking care of your Survivor Benefits during out-processing.
