Got my retirement orders today Dic. 31

You are released from assignment and duty because of physical disability incurred while entitled of basic pay and under conditions that permit your retirement for permanent physical disability

Date place on retired list :Jan/23/2014

Retired grade of rank: E-5

Percentage of disability: 80%

retirement type and allotment code: 12 ?

Component: ARNGUS

Authority: 635-40

Statute authorizing retirement: 1204 ?

Disability retirement: 2 Years, 11 Months, 24 Days

Basic pay: 9 Years, 0 Months, 12 Days

Disability is based on disease or injury received in LOD as a direct result of armed conflict or caused by an instrumentality of war and incurred in the LOD during a war period as defined by law: YES

Disability resulted from a combat related injury as defined in 26 USC 104: YES

(what is the code 12 means and the statute 1204 ?)

The "Statute Authorizing Retirement 1204" refers to 10 U.S. Code, Chapter 1204 as the statute authorizing your retirement. Chapter 1204 applies to "Members on Active Duty for 30 Days or Less or on Active Duty Training:Retirement."

I'm ARNG also and my retirement orders also stated 1204 for the Statute Authorizing Retirement Orders. Seems to me the PDA should have cited Chapter 1201 "Regulars and Members on Active Duty for More Than 30 Days:Retirement" because my injury occurred 5 months into a 12 month OIF tour while on Title 10 Active Duty orders. Baffles me as to why they would cite 1204 rather than 1201 on both your retirement orders and mine.

Gomez: I need to wait until the January 7 because the RSO in my NG HQ is still drinking rum or like they says he is on vacations so i need to wait but i am going to ask about the 1204 statute ? because i am in the same boat as you i got med evac from AFGHANISTAN in the 9 month of my 12 month deployment , I think we suppose to have the 1201. unless are some difference in benefits or money ?

or maybe is because we are not active duty now?

like me in stead of have a DD214 THEY ARE GOING TO GIVE ME A NGB 22 despite we have injuries incurred in LOD under tittle 10 or in combat . hope any one hear can explain some ting about theis to us

I was deployed in the ANGUS to OEF on Title 10 12301(D), was med evac only 7 days into my deployment to Germany for 3 days then med evac to DC. I officially was placed on MedCon orders for treatment less than two months after being placed on Title 10 12301(D) once I was placed on MedCon I was placed into Title 10 12301(H) for the rest of my treatment/IDES case. When I requested to come off Title 10 12301(H)/MedCon orders over a year into treatment/IDES case processing I was issued a DD214 and was discharged under Title 10 12301(H) Honorable. Long story short, I would follow up with your unit and if needed bring in the laws pertaining to this medical separation and specifically print out Title 10 Section12301(D) & 12301(H). I'm pretty sure if your are separated for medical reasons while on Title 10 12301(D) or 12301(H), and if you completed over 30 days to Title 10 12301 orders you need to be issued a DD214. I would go to your command and have them fix this for you.

1.Ankon1979, on my orders, the Retirement Type and Allotment Code is marked "Permanent/12". Does it say "Permanent" or "temporary" on your orders before the "12" Allotment Code?
2. I received a DD214 when I came off Title 10 orders. Once back in my National Guard unit, I went through the IDES for my active duty injury then was disability retired and given a NGB22/NGB55. Seems that you should have gotten a DD214 from active duty as well as a NGB 22/55 releasing you from the Guard. Like Tim B said, I would go to your command and request that you get your DD214. It's important and you'll need it.
3. I still would like to know why our orders erroneously refer to Chapter 1204 instead of Chapter 1201. I speculate that the Army PDA, where our retirement orders are cut, is mis-using 1204 as a way to categorize us as Reserve component, as opposed to active duty, disability retirees. I don't see that our benefits are affected regardless of whether 1201 or 1204 is specified on the orders.

Gomez, yes my retirement type and allotment code is (12) as well, and yes my orders are Permanent i write down a copy my orders way up top on this discussion missing some bull stuff bla bla but basically all .

I do have a DD214 wen i get out WTU in 2010 when I came off Title 10 orders , an i ask to go back to my NG unit drill status but we i get back my NCOIC told me that i can't go any more i was transferred to another unit MOS qualified and i report only to know that i was schedule to go back with that unit to Afghanistan , so i began training and at Camp Santiago doing the stupid PTAE pre mobilization training my back began to bother me ass well the anger an all good stuff so i wen to the medic and the primary give me a L3 and none deployable profile so i get out that training and mob drill status . so i begin to go to VA until they give me 80% SC and start the MEB.

Now i got my retirement orders with all that state above in my firs post but yes i going to get a NGB22 because i am not on active duty despite my retirement is all combat related because i am not in active duty orders but basically the NGB22 is the same as the 214 for the active duty works the same for VA. i am going to ask about the 1201, 1204 codes but i don't tinl is a big deal on benefits or money is a mere administrative issue
