From what i have been reading on the VA website their is special compensation rates if you are rated 100% and they determine you to be unemployable. Does anyone have any insight on this.

Are you in need of Aid and Attendence? have loss of use? Don't have to be unemployable to qualify for specially monthly compensation (SMC)

Myself fall under the SMC table and I'm not rated unemployable
 
Special Monthly Compensation

Compensation for Serious Disabilities

VA can pay an added compensation (paid in addition to the regular Disability Compensation) to a veteran who, as a result of military service, incurred the loss or loss of use of specific organs or extremities. Loss, or loss of use, is described as either an amputation or, having no effective remaining function of an extremity or organ. The disabilities VA can consider for SMC include:

  • loss, or loss of use, of a hand or foot
  • immobility of a joint or paralysis
  • loss of sight of an eye (having only light perception)
  • loss, or loss of use, of a reproductive organ
  • complete loss, or loss of use, of both buttocks
  • deafness of both ears (having absence of air and bone conduction)
  • inability to communicate by speech (complete organic aphonia)
  • loss of a percentage of tissue from a single breast, or both breasts, from mastectomy or radiation treatment
A Combination of Disabilities
The VA will pay higher rates for combinations of these disabilities such as loss or loss of use of the feet, legs, hands, and arms, in specific monetary increments, based on the particular combination of the disabilities. There are also higher payments for various combinations of severe deafness with bilateral blindness.

Additional SMC is available if a veteran is service connected for paraplegia, with complete loss of bowel and bladder control.


In addition, if you have other service-connected disabilities that, in combination with the above special monthly compensation, meet certain criteria, a higher amount of SMC can also be considered.

If a veteran is service connected at the 100% rate and is housebound, bedridden, or is so helpless to need the aid and attendance of another person, then consideration of payment of additional SMC can be considered. The amount of SMC will vary depending on the level of aid and attendance needed.

Individual Unemployability is a part of VA's disability compensation program that allows VA to pay certain Veterans disability compensation at the 100% rate, even though VA has not rated their service-connected disabilities at the total level.

Thanks for the info. I dont think i would qualify for any of the SMC stuff and i understand the unemployablilty thing where if you arent 100% they can pay you 100%. I just dont know what she was talking about then. I guess i will have to wait and find out.
 
Talked with DAV rep out of Seattle and got a sneak peek at me proposed ratings. 80% VA / 40% DOD but will have to wait until the PEB sends the 199 to confirm. I'm now :D and at the tail in of things I hope. Since I'm guard and already had an existing percentage I get it all paid now.
 
Well today marks day 24 since signing my 199 and still no orders. It will be 18 business days and not counting the day of signature. Only thing I have been told was that PEBLO was told my 199 was with an analyst as of Monday and that it would be done by Tuesday or Wednesday. No transproc message on Wednesday so here's to hoping it was completed yesterday and I will be on the list today. Cutting it real close to my hopeful final out for 31 March and starting leave 1 April. Transportation already told me if I don't get orders by the end of this week, it is highly doubtful I will get my 60% advance for my DITY move by 1 April. God this process is insane and in no way helps a Soldier with their transition no matter how many classes and briefs you go to... Fingers crossed for a good day today!

My Status on Ebennies just changed to gathering evidence: Requesting documentation for seperation. How long does it take from the time of the change until i get my ratings then my DA199

Depends bud. From what I have seen...... Everyone is different. Some people get it in a week. Some don't get it for 3 weeks! As long as you know your getting it.... you are good to go!

I got my 199 2 days later but it could take 3 weeks like billy said

Yep right indeed. I will see how long it takes to get my 199 as I don't expect it this week, maybe next week.

you can call the PDA to find out what the status of your 199 is. just google "Army PDA" and call the 1800 number. An analyst will tell you when your 199 was received and roughly when they expect to send your TRANSPOC message
 
So i signed my 199 today 20% DOD 90% VA now i am getting a severance pay and in block 5 on the 199 is says the disability severance pay was awarded for disability incurred in a combat zone or incurred while performing combat related operations as designated by the secretary of defense ( 10 USC 1212) so does this mean it will be taxed but not recouped by the VA thanks in advance
 
Claim went to closed today. No change in benefit letter. Also 2 new claims were open one says under review and one says pre determation. I know one is for drill pay. Also my dependent claim was closed today to. No clue what is going on! Grrrr
 
Correction : One says "authorization review" no estimated time for completion. Second is my "pre-determination" for my drill pay.

Your claim for ratings is done then, congrats. The authorization is for your cola, and the other one is like you said for your drill pay. I'm surprised they are still open as the closed all mine out the same day they finished my ratings and I've already gotten the back pay.
