Despite my PEBLO officer convinced I would undergo full MEB, AFPC decided I will return to duty. My injuries have direct tie to combat engagement, and I’m surprised that the board decided to non-concur the disposition recommendation for MEB by my treatment team and CC. Additionally, I find it frustrating that AFPC can inform PEBLO offices they’re running behind on disposition decisions, when the regulatory guidance (DAFMAN 48-108) uses directive language to have a decision within 10 calendar days. My case exceeded well past that timeframe (which requires a higher level waiver that may/may not have happened). I’m interested in getting that info as well as a rationale on their decision. The guidance highlights that I cannot appeal AFPC’s RTD decision, though it says nothing of legal counsel appealing on my behalf. I’m not kosher with slapping the table based on an informal board that decides RTD vs PEB and only having the ability to have legal representation to appeal only in the PEB process. Any recommendations? Thanks!
