Please help..
My TDRL 5 year deadline will end in 3 weeks as will my families Tricare Ins. I finished my last Medical Exam fot the MEB in April 2012 @ the contractor Ivan Walks & Associates has been handling my case. They continue giving me the run around & never directly answer my questions. What can I do? I was given an initial PEBLO Rating of 30% in 2008 w/ a VA rating of 80%.

Can I take this contracting company to court or file a class action suit against them?

I would focus on the most pressing issue first; final adjudication of TDRL so you don't lose benefits. Have you contacted USAPDA? Congressmen? PEB? DFAS?

You need to keep the benefits going so there's no lapse for you and your family. Once that is straightened out look into other options. For the record, many SMs appear to have problems with Ivan Walks. I recommend to everyone that has a bad experience with them to contact as many people/agencies as possible. Without action the cycle will likely continue for others.
 
I agree with Pittpan. Five years is the STATUTORY maximum for TDRL. Not even the BCMRs can override it. Go to the PDA.

So what and when was your last PEB/TDRL outcome?
 
I am also waiting for Ivan Walks & Associate to get me a appointment date. I have spoke to the PEB in regard to wen i will be getting that appointment and nothing so far.
 
Ivan Walks is TERRIBLE about getting back to people.

I called my case manager over 10 times (yes, 10) and sent 6 emails and he did not reply. I got a call from an IWA doc for a phone interview. I bitched an complained to him and told him how bad IWA sucks about getting back to people.

FINALLY I got a call back, after 21 months !

I had a TDRL med exam and just received the packet from IWA. NOW they want me to jump and sign it and return it in 3 days.

Don't hold your breath for these people, they are ridiculous and they ARE NOT looking out for your best interest, they are only concerned with ramming you through the process at THEIR convenience, and then collecting their fee from DoD for processing your case.

Inept is the word I am looking for here.....
 
Wow! This is news nobody wants to read about and yet the it continues to roll down hill like a tire on fire! :mad:

Moreover, I am NOT looking forward to being a participant within these "games" but I will be forced as based upon my DoD rating medical condition(s) PEB determination for retirement.

BTW, upon conclusion of my interactions with the NCRPEB SPEBC, they mentioned that the trend from Iran Walks & Associates (IWA) TDRL re-evaluations are resulting in significantly lowered ratings by the USAPDA PEB; information that I didn't want to hear with forthcoming mandatory experience!

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

Were you an IDES or Legacy case? The VA should provide the final rating if you were an IDES case.

Likely, there is no action you can take directly against IWA. However, against the Army, you may well have a case.
