TDRL reeval help

Ok here are my stats first and formost:
100% total VA:
70%-ptsd
50%-sleep apnea/asthma
30%-migraines
10% right knee
10% left knee
10% tinnitus
20% back

70% total AF CRSC
70% ptsd
0 % asthma

My official TDRL date is 27SEP2012 and VA started 01JAN2013.
Heres my question I did my TDRL re-eval in may and today I got the results and they are recommended tdrl to perm retirement and downgraded my af rating of ptsd from 70% to 50%. they still haven't awarded me anything for asthma simply cause no one can relies that burn pits affectedmy lungs but that's a whole other matter on its own.
Will this affect my VA rating or is it just an af rating for retirement pay I know it will affect my crsc pay but im not concernd with that. Im not able to work due to my ptsd but va has not awarded that yet as im going through there programs and blah blah politics. any insight will greatly appricated

When was your most recent C&P exam for the PTSD?
 
that is correct not other C&P since IDES. And I really don't want to fight AF on this its jus going to make me worse as ptsd trigger is stress lol. If I can keep va rating I have no problem with af changing theres cause I really don't hav it in me to duke it out. also VA original award date it 19DEC2012

Ya know typically, I would say yes they will lower you, but im not 100% sure since it was not a va doc/c&p exam. But i thought under new regulations they could not lower your DoD rating unless it was done via the VA. They may submit the records to the VA and request a lower rating, and you can fight it etc. or accept and file for TDIU or just an increase for one of you other conditions if its warranted, but honestly I am not 100% sure.

In my opinion referencing your PTSD medical condition, the DoD (Air Force) doesn't have the authority to decrease your DoVA D-RAS proposed rating of 70%. Therefore, the DoVA D-RAS should use your PTSD proposed rating of 70% during their adjudication process to generate the DoVA final rating.

Since you underwent the mandatory TDRL six-month re-evaluation for PTSD, it was probably adjudicated via the DoD Legacy DES process which matches the information I received from my NCRPEB SPEBC attorney during my FPEB hearing. Are you satisfied with the recommendations of the board? Can you live with the PDRL with decreased AF rating for PTSD? If so, then pre-congratulations on your forthcoming military disability retirement! ;)

With all that said, I believe you shall potentially retain the DoVA proposed rating of 70% for PTSD, but will receive a decreased AF final rating of 50% for PTSD; two different agencies yielding two incompatible disability ratings.

Afterwards, I am not able to provide creditable assistance to the reminder of your inquiry as to the distribution priority of disability compensation between the DoD (Air Force) and the DoVA. In addition, how will the DoVA react to the DoD (Air Force) decision to decrease their D-RAS generated rating for overall disability compensation purposes? But, there are other PEB Form members who hopefully can provide some sound insight soon.

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

My first question would be does the lower DoD rating actually affect the benefits you receive? Often it will not as long as the rating stays above 30%. You will need to do the math on that one but is your VA compensation greater than the amount of your DoD disability retirement at 70%?

Ah ok. No, it shouldn't directly affect your VA rating. And, if your main concern is to maintain retirement, then they are offering you that so...congratulations! :) But you will have another VA C&P for the PTSD at some point.
