Terminal Leave Calculation

So how do they calculate your terminal date/retirement date? I currently have 72.5 days of leave and if I appeal and get retired ill get the 20 PTDY. I am trying to determine if I should burn some leave now and my only concern is that if I take the leave now, I will have to wait later to get out. Is this true or will I be able to request an earlier date of sep/ret?
 
If you are Army here is what DA PAM 635-40 says on page 11:

(4) Soldier transition phase. The Soldier transition phase of the IDES includes processing the Soldier for a return to
duty or for separation. The IDES goal is in 90 days (plus any amount of accrued leave and permissive temporary duty
the Soldier is authorized to take) from the date of approval of the final disability disposition decision to the date of the
Soldier’s separation from the Army.

5.16. Establishment of Disability Separation/Retirement Dates.
5.16.1. AFPC/DPFDD determines the retirement or discharge date at the time the orders are published. Appropriate processing and permissive TDY time are considered when establishing the effective retirement date. All disability separation/retirement dates will be at the end of the month.
5.16.2. Service members retiring or separating for disability may sell their accrued leave up to the maximum of 60 calendar days permitted by law. If leave is not sold, it is used as terminal or ordinary leave through date of separation or retirement per AFI 36-2910.
5.16.3. AFPC/DPFDD will establish disability separation and retirement dates as follows:
5.16.3.1. The date of separation or retirement is established upon finalization of the service member’s case. (T-3). AFPC/DPFDD calculates the effective discharge date providing a minimum of ten calendar days for out-processing, 20 calendar days Permissive Temporary Duty and accrued leave.
5.16.3.2. For the purposes of Benefits Delivery at Discharge and receipt of benefits and compensation from the Department of Veterans Affairs, the date will be established no earlier than three calendar days from the end of the month. Note: Any unsellable leave is required to be taken prior to the service member’s separation or retirement date.

Just FYI for the Army they have to let you use all of your leave towards terminal leave. They can't force you to sell it. You can get the NLT date moved back:)

I did not know that about the Army! Not that it matters anymore. But I got over on the Army for 45 days of leave when my child was born and the S1 couldn’t find my leave form when attempted to signed back in. The S1 clerk, who I always took care of, told me not to worry about it!

Thank you for researching the regulation (for leaves) that pertains to a service where you did not serve. Going the extra mile for another member of the military/veteran.

i. The “not later than” date, set by the U.S. Army Disability Agency, may be exceeded to allow the Soldier to use
accrued leave as terminal leave only if the Soldier has cooperated to meet transition requirements, and has not willfully
failed to comply with instructions in accordance with time lines of AR 635–8 and AR 635–40. These requests will be
processed in accordance with AR 635–8 and AR 635–40.
