Emailed PEBLO asking about status and informing her of the VA App status. PEBLO called, said I didn't hear it from her, but it said 100% VA. So, I've got that going for me, which is nice.

Emailed PEBLO asking about status and informing her of the VA App status. PEBLO called, said I didn't hear it from her, but it said 100% VA. So, I've got that going for me, which is nice.
9 JAN 24- DA 199 arrived from PEB to PEBLO. Unfit, 10% DOD (Longevity Retirement), 100% VA plus Homebound (single disability 100% and multiple others totaling at least 60%) that I was not expecting. Legal review scheduled for 12 JAN 24 before signing. I'm going to get the assurance from legal that I can still work under this proposed "Homebound" designation.

2 questions for you when you looked at your Va proposed ratings where did you see the ch. 35? I read mine but didn’t see anything I just want to make sure just in case because I’m at 40% DoD 100% VA. Second when do you expect to see orders after having the out brief on the 16th. Mine was yesterday and I’m anxiously waiting. As my unit is already giving me a hard time

On the second to last page on my proposed ratings packet, there's an item that states, "34. For Department of Veterans Affairs (VA) benefits, proposed eligibility to Dependents' Education Assistance under 38 U.S.C. chapter 35." Then, two paragraphs down, it states, "Basic eligibility for Dependents' Educational Assistance is proposed as the evidence shows a permanent and total disability(ies).

Your outbrief doesn't have anything to do with getting your orders. Your outbrief is with the MSC to go over the proposed ratings and all the benefits you will be entitled to. The orders come from the submission of your DA 199 to the US Army Physical Disability Agency. They will send your installation Military Personnel Division (MPD) who will send you information on what paperwork is required in order to receive your orders and, if necessary, how to extend your No Later Than date.

Tell your unit to pound sand. Regulation states that the commander WILL assist in expediting your clearance process and will afford you all time required to do so. You will have 14 days from your notification date (the day MPD emails you with clearing information and paperwork required to get your orders) to clear the installation. I'd advise going to CIF Monday with your DA 199 and scheduling your turn-in appointment. Fourteen days go by quickly, so do everything you can do without orders and don't procrastinate. If your unit gives your problems, contact your PEBLO or Ombudsmen.

I submitted and signed my DA199 on JAN 11th. My Peblo told me to expect something within 2-5 days of doing this. I was tracking that the out-brief had nothing to do with receiving the orders I just figured I would mention that I’m sort of on the same step as you, since that was the last update you gave us.

I will definitely be going to CIF Monday with DA199 to try to make an appointment. Hopefully I also hear something from somebody as well on Monday. Again thank you for this detailed response and helping me with this process.

You're very welcome for the info. I try to help others as much as I can as I know this process can be confusing and like drinking from a fire hose.

That is what my MSC and personal research has told me is evidence as P&T. Nothing is final until you receive your award letter after separation, however.

Just out of curiosity, did your MSC not explain this to you? If not, he/she did you a major disservice. Have you applied for VR&E? If you're on Active Duty, you're automatically entitled. Contact a VR&E counselor quickly if you haven't already done so. Even if you don't wind up taking advantage of VR&E, you will have the option. Once you're off of Active Duty, you're in the same application pool as all Veterans.

When I read over my proposed ratings I couldn’t find anything on my packet with CH. 35 on it (because I missed it) so when I found someone who did on this forum I figured I’d ask just in case.

However for the VR&E he made it seem like even if I waited, after I separated I could still apply for VR&E. If that’s not the case I can read more on VR&E I already have my toes in the water with that subject. But I’ll definitely talk with a counselor about the VR&E before I separate.

I just have a lot on my plate right now because I am AD. And like I mentioned before my unit is making it seem like it’s a taboo to separate from the Army. They pick and choose what regulations they like to follow, I’ve already went to IG, Jag, EO etc… however I’m so close to getting out. And any time something does come up where the unit gets in trouble it seems if you’re SFC or above you just get a slap on the wrist and told not to do it again. And to make matters worse the ones who get the slap on the wrist protect their favorite SSG’s and SGT’s lol it’s one big joke IMO. But I’m going down a rabbit hole I’m sure everyone has experienced a unit or two like this before.
 
My MSC did explain CH. 35 that seeing that is evidence and more than likely going to mean P&T for you but it’s not a guaranty. 10 JUL (later that day)- Told to expect PEBLO to come to Rucker/Novosel TDY on 24 JUL from Fort Lee/Greg Adams.

26 JUL- Rucker/Novosel hired a PEBLO who begins next week. Made contact. No case has been made for me in IDES. I, and many others here, will be starting from scratch after multiple months of waiting. At least we will finally be starting.
28 JUL- Intake brief with PEBLO. I just kind of walked into her office to talk, and she went ahead and knocked out the brief. This new PEBLO is motivated and sharp. Makes me more confident in the process.
1 AUG- Briefing with MSC to file claims. During the meeting, I informed the MSC that I wouldn't be available for six business days (21-28 AUG). This is the one week ALL YEAR that I can't be available. So, my case can't be submitted until I return. Pretty frustrating as I should have been with the MSC submitting claims in May. Anyway, my new briefing with the MSC to file claims is scheduled for 29 AUG.
29 AUG- MSC submits paperwork for C&P Exams.
31 AUG- Receive letter in mail from QTC to call and schedule exams. Immediately called to schedule, was told they are missing one form (the self-health assessment or "SHA").
1 SEP- Called MSC to report missing paperwork. He called BS and made some phone calls. Was told to give it an hour and call back. Two hours later, called back. QTC still didn't have the form.
4 SEP- Overseas employment accepted with tentative start date of 3 January. We'll see if this works out.
5 SEP- Called QTC to schedule exams after Labor Day holiday. C&P Exams scheduled by QTC with no input from me. No problem, I have nothing else to do. Last appointment is scheduled for 27 SEP. PEBLO will submit expedite memo immediately upon completion of last C&P exam.
27 SEP- All QTC C&P Exams Complete. Awaiting Head-to-Toe exam DBQ to be uploaded to TOL. All others have been within 24 hours of the exam.
11 OCT- All DBQs uploaded to TOL. Some leave me scratching my head and are contradicting. Some say the opposite of what the examiner discussed with me. I guess we'll see how it goes. PEBLO is on leave until 16 OCT, so no action until then.

16 NOV- MEB physician added an additional disqualifying condition-UPDATE: MEB Physician also adding PTSD to disqualifying conditions.
30 NOV- Second signature received on new unfitting conditions on medical profile.
6 DEC- DA 3947, NARSUM, and final profile complete. Awaiting legal review. Legal brief scheduled for 11 DEC.
11 DEC- Legal brief complete. Estimate 0-10% DOD (it's complicated), 100% VA.
11 DEC- DD 3947 signed. Will be submitted to PEB today with expedite memo for accepted employment.

After a review of my qualifications and goals, I will be attending school to complete an MBA at the VA's expense (tuition, fees, supplies [computer, etc], books, etc)...and they will give me a living stipend while attending on top of the VA disability compensation. VR&E is an AMAZING benefit that not enough people take advantage of. Please, at least apply (you're automatically approved while on Active Duty) and speak to the VR&E counselor.**********
5 JAN 24- VA App shows "Closed" on claims. I didn't see this until 8 JAN, but I wasn't looking in the right place. Ensure you select "closed" claims to see if your claims are there. Emailed PEBLO asking about status and informing her of the VA App status. PEBLO called, said I didn't hear it from her, but it said 100% VA. So, I've got that going for me, which is nice.
9 JAN 24- DA 199 arrived from PEB to PEBLO. Unfit, 10% DOD (Longevity Retirement), 100% VA plus Homebound (single disability 100% and multiple others totaling at least 60%) that I was not expecting. Legal review scheduled for 12 JAN 24 before signing. I'm going to get the assurance from legal that I can still work under this proposed "Homebound" designation.

It’s no worries man I love the Army it’s given me things I’d never be able to experience in the civilian world. Unfortunately we all come across unpleasant co-workers at some point in our lives. I’m ready to move on with my life now. Good luck to you brother and congrats on receiving your NLT.

It's official: I'm retired as of 27 April. I received my VA Decision Letter on 1 May. It was the same as my proposed ratings.

10% DOD. VA 100% Permanent and Total. Special Monthly Compensation for Homebound (I can still work).

All in all, yes. There were several claims rating lower than I believed they should have been based on medical evidence, but it would be silly for me to fight them since it wouldn't result in anything more favorable than I received. I had no claims denied. Several with 0% ratings, but they are still service connected for future medical care.

I mean, I wish I could have stayed in the Army healthy and retired on my own terms, but hindsight is always 20/20.

Well, I'm sorry you didn't go out on your terms, but glad you are ok with the ratings. You definitely had a long process so I'm sure it's a huge relief to be done with it all.
