Title 32 Technician Medical Retirement Scenarios (Please limit posts to "Technician Medical Retirements")

Yes, if you have a 30% or more DOD disability retirement and
DON’T have more than 20 years under FERS and
ARE NOT older than 50 years old

You were hired after 1996, must have 20 years under FERS and be at least 50 to get a minimum retirement. Basically if you meet these requirements OPM will retire you normally, not disable.

The most important part is NOT to meet the standards for a normal minimum retirement or OPM won’t let you have a 60/40 disability because your already have reached retirement.
So, just starting the process, 16yr mil tech, 29 year MSgt. I can buy back 4years prior to tech start time. This would put me at 20 yrs service. and I turn 50 this year. Would this put me on standard retirement, not medical retirement from title 32 tech position? Kinda confused since this would be under "early/discontinued retirement", the army benefits center told me this was a voluntary retirement when they offer it. Im just looking for clarification, I would not be suprised if they didnt track that I would be 50. Thanks for all the info everyone on here takes the time to dispense.
If it does follow under early/discontinued would it be best to not to buyback?

Buy back time doesn’t count towards 20 years, it’s added to creditable, qualified time (years) when retirement is calculated. It also forfeits most military retirements because you can’t double dip with time. If time is used for a military retirement you can’t then buy the same time and apply it to a FERS retirement also.

BLUF: Buying time back is almost always beneficial
 
I guess at this point i need a good lawyer or two, first would be for mil medical retirement and then technician medical retirement anybody have suggestions? 2 in 1 would be great, but not at the expense of experience/knowledge

I would read the whole thread. You’re talking about two different type retirements and we need more info to help.

I'm being med boarded with unfit for duty NARSUM due to combat related injury… looking for clarification on eligibility for VA Disability, DoD Retirement, FERS Disability, and if any can be received at same time. I believe VA Disability and FERS Disability is the answer, but not 100% certain.

Hello, you will get full va compensation, on fers disability first year you’ll get 60 percent, and after that 40 percent till you hit retirement age 62 and go to regular FERS retirement, you do qualify for Military retirement, but lose dollar for dollar to VA compensation. Apply for CRSC to get something better than nothing. Now for if for some reason your military retirement is more than your VA, you’ll still lose dollar for dollar, but you end up getting whatever is left over. Hope this helps

Yes, as it would add more time to your retirement at 62. While on FERS disability, your 7 years will continue to accumulate till you reach 62. So those 4 years will be added if you buy back. Also, don’t forget you will not be able to make over 80% of your high 3.

Thank you. I just received my VA rating yesterday and expect to get a DOD rating in the coming weeks. After that, I’ll be medically Seperated from my Title 32 tech position. Of the VA Disability, military medical retirement, and FERS Medical Retirement, which apply to me post retirement? My disqualifying injury occurred in combat. I have a lawyer that specializes in IDES who said the VA disability and military medical retirement will not count against each other, although he isn’t familiar with how FERS medical separation retirement would factor. Any insights are appreciated, thanks!

You will get VA disability, and lose military medical retirement dollar for dollar, anything left you will get paid. When I went through the process, my PEBLO said that I would get my retirement and FERS disability pay, but that was not the case, they don’t know all the information, since this doesn’t happen often.
