VA ratings and Medical Retirement Orders

Just got my ratings a couple of weeks ago from my PEB. The VA gave me 100% the Army 40%. I have 25 yrs active duty. My question is Do still get to keep my 65% form the Army because my orders show PERCENTAGE OF DISABILITY : 40% and the retirement allotment code that says: PERM Disability/10. I was told that because I am over twenty I get my normal retirement pay(check) and a VA check separate. Cant really get a straight answer looking for feedback. I would greatly appreciate it.

Msmith2052: Congrats on completing the PEB Process. Since your PEB rating is lower than your Length of Service, you will receive your Length of Service of Retirement: 25 x 2.5= 62.50%.

Lastly, have you reached out to the Soldier's Counsel? They should be able to explain this to you as well.

Your will be getting your earned retirement from the DoD plus 100% from the VA. Your retirement will be what was earned not the 40% or whichever would be higher.

I had over 20 yrs with the AF and was MEB'd with 80% and paid and 75%. When my VA kicked in my pay dropped to 57.7% (earned retirement) and was getting 90% VA. There was a deduction to my DoD pay which I understood to be the difference between the 75% and 57.7%. This amount was something like 4&50 for me.
 
Hi, I am awaiting my ratings. One of my issues is memory loss and concentration. With all this being said. I do not understand the difference and how they deduct one from the other to make the DoD less. They I am told I have to choose from between the
Combat-Related Special Compensation (CRSC) and Concurrent Retirement Disability Pay (CRDP). I have 23 yrs AD service. I have lost all math skills and need to really be guided through this difficult part. Soldier counsel says probably 80 DOD and 100 VA
 
Question, My first time but is Frequent Blood Clots, is the reason am getting MEB-ing with 24 years active. Do you know if i will come back unfit, even if I already have my retirement orders for FEB16, am a 12B and i cannot perform my dutie. again thanks please help

In my opinion, there doesn't exist ample information to make any potential determination as to your "fitness of duty" at this point in time albeit you state that you are currently unable to perform your assigned MOS duties as a 12B.

As such, it's very interesting to hear that you are being officially referred for acceptance into the DoD IDES MEB/PEB process with approved military retirement orders at this point! :confused:

Hmm, you may have an opportunity to obtain additional retirement benefit compensation (via a military disability retirement versus a military length of service retirement) if referred, accepted and determined "unfit for duty" while in the DoD IDES process. ;)

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

thanks for the quick respond, I hope i come back unfit, am waiting on my NARSUM now, for i can just enjoy life, with these Blood Clots am limited to do not to much. I was told worst case if it come back unfit, I will already have my claim done and have to wait about 3 months to get my rating, but i will keep you posted again thanks

next question, sorry but i was shorthanding above alot i see, sorry about that. but do you think it will come back fit or unfit if i have retirement orders already. they are MEB-ing for blood clots but when i started my appointments i added alot more like ptsd depression, pain and hearing etc. again thanks

No worries! In my opinion, it's hard to predict exactly how the DoD IDES MEB/PEB shall interpret your IDES case file with approved military length of service retirement orders currently in your possession.

As such, that's why I previously made the comment that it's very interesting to hear that you were officially referred and accepted into the DoD IDES MEB/PEB process with approved military retirement orders at this point in time! :confused:

To that extent, procedurally, the DoD IDES MEB is required to review and address all medical conditions (e.g., all injuries/illnesses) on the Department of the Army (DA) Form 3947 (Medical Evaluation Board Proceedings). That said, you must ensure that all medical conditions are accurately and completely listed on the forms provided during the physical examination. The examining physician will address those additional conditions, document findings and, if appropriate, refer you to additional specialists for further evaluation.
