VARR or FPEB

I would like the condition code that was used to rate my condition, which is unlisted in the Schedule of Ratings, to be reconsidered. I have evidence that supports this reconsideration. Should I have requested a VARR instead of a PEB. From what I have researched, the VARR is used to have ratings reconsidered. I have not been assigned a FPEB date yet. If a VARR is a better choice, is it possible to have the request for the FPEB dropped or put on hold? Can I have a VARR open if I have a FPEB pending? Thanks.
 
Not sure which service you're in but when I requested my FPEB I also requested then to be able to apply for a VARR. The VARR won't happen until after the FPEB happens and in the AF it also won't happen until after you appeal to the SAFPC (if you were to decide to go that route).

Thanks for your response.I am in the Navy. I hope that they will allow the VARR before the FPEB. If they VARR comes back with favorable results, I will not have to do the FPEB. That is what I am trying to avoid.
 
I think it is important to discuss this with your PEB attorney to ensure that they are fully on board and will preform the request in a manner in which it is most likely to get approved. It may be a no brainer in your mind, however if not communicated effectively...
 
My FPEB happened before the VARR was put in by the FPEB JAG. I believe they wait until after the FPEB as more conditions can be added and more VARRs could be requested. I am expecting a finalization within 2 months from now.

Also it's possible at the FPEB you could be found fit and VA would take no action. It really depends on your case and the amount of evidence provided to reach your desired outcome.

That's what I want to avoid. I do not want to be found fit when I am just trying to get a VA condition code changed.

Thanks. I go see my attorney this Friday. I was just wanting to get a answer before then to see what is usually done. I just want to avoid the Formal PEB now that I considered they could make me Fit when all I want is a reconsideration for condition code. That would be HORRIBLE.
 
VARRs only applied to unfit conditions regardless of branch of service as this is a function of VA. The branch however, need to find the condition as unfit by means of IPEB of FPEB prior to the VARR submission.
 
I couple of years back I assisted a sailor going throug the DES. I wrote a letter to the PEB requesting the VARR first, followed by a FPEB if necessary. The PEB agreed, the VARR was favorable as was the PEB's interpretation of the VA's new rating for the condition. No need for the FPEB.

Thank you. I am going to ask my attorney to do this if possible. I just want my unfit VASRD condition code to be reconsidered. So, if the VA does this, I will have no need for a PEB. I dont want to risk the chance of being found Fit.
 
Ok guys, my Lawyer said that I can just withdrawl my FPEB request and do the VARR instead. He said the important thing is to have the right evidence to support the analogy. I definitely have the evidence now that I talked with the NMO Neurologist at John Hopkins. He is one of the go to doctors for this disease and he said he would reach out to my neurologist. He agreed with what I was saying in regards to my analogy logic. Fingers crossed. I'm stoked at this point.
