I was placed on TDRL, but I was also awarded 100% P&T. DoD rating 100%. I was disappointed that I was placed on TDRL especially since I have 21 years of service. Are you able to explain what the differences are for TDRL and PDRL? My PEBLO, VA MSC, and IDES Lawyer say there is no real difference for my situation, but I don't believe that.

Indeed, I can definitely comprehend your current situation! Hmm, there is one big difference which is PDRL versus TDRL in my opinion.

Being placed onto the DoD military PDRL means that all PEB referred "unfit for duty" condition(s) was(were) deemed "permanent and stable" for rating purposes only; you are free from anymore further military scrutiny. Unfortunately, TDRL means that one or more of your PEB referred "unfit for duty" condition(s) don't meet the aforementioned criteria at this particular point in time.

As such, placement onto the DoD military TDRL after January 1, 2017 shall render you up to three years on TDRL versus the previously five years (which I am currently placed under). Dependent upon your PEB referred "unfit for duty" medical condition(s), you shall have a TDRL re-evaluation between six to 18 months in duration for the initial TDRL examination then 12 to 18 months thereafter up the three years.

The TDRL PEB referred "unfit for duty" condition(s) is(are) deemed "permanent" but "not stable" for DoD rating purposes at this point in time. Based upon your receipt of a DoVA 100% P&T rating, it would seem that you should receive a DoD rating during your forthcoming initial TDRL examination which shall place you onto the DoD military PDRL at least in my opinion. I see. Thank you for the info. When I met with the AW2 advocate they mentioned that I should come off the TDRL immediately following my initial TDRL examination. Again, hard to tell what the truth might be with so many different organizations telling me so many different things.

Hi Warrior644, what advice could you give me for an PEB Appeal memo? I am at the point to type up one and I don't have any help from PEBLO and I don't trust the legal counsel at Atterbury. They have given me the round around a lot this year and things just doesn't feel right with them.
BLUF: on my DA199 the only things unfitting was my lower back and diabetes T2 which are the same things that were listed on my profile for referred. So I'm needing my Asthma (with two max dose steroid inhalers), Shoulder injuries, Heart condition and cervical condition added to my PEB appeal for unfitting.
I'm thinking that I need to fill out my memo in a brief paragraph on each thing explaining why I think it's unfit and issues it causes in my military duties.
Am I off track or hitting the nail on the head? Any thoughts is much appreciated.

Hello! Since your DA Form 199 is completed and hopefully not signed at this point, it would seem that your option is to appeal and request a Formal PEB (FPEB) hearing.

DoD Legacy PDES (Post-DoD IDES MEB/PEB) case status:
DoD military TDRL rescheduling for a final PTSD re-evaluation examination during May 2018 might not occur due to an unexplained lost of information in my TDRL file at the USAPDA TDRL Branch; therefore, they never routinely scheduled it. As such, my contact information was again updated and now assignment with future contact from a TDRL PEBLO should occur within 60 days via the nearest MTF; that's potentially 30 days past the originally scheduled timeframe.

DoD Legacy PDES (Post-DoD IDES MEB/PEB) case status:
Via continuing positively proactive measures on my own behalf, the DoD military TDRL scheduling for a third periodic TDRL medical examination (i.e., PTSD re-evaluation) is now rescheduled to occur on or before July 2018 and arranged by an Army Military Treatment Facility instead of the U.S. Army Medical Command's Maximus DLH Solutions Corps contractor.

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer!"

I wanted to personally thank you for all your content on the forum I have been lurking for years now and have aggressively followed your advice and it ended up being in my favor. I was placed on TDRL in June of 2015 with a 70% DOD rating and a VA rating of 90% the only problem is my DOD pay comes out way higher than my VA pay so me keeping my 70% over onto PDRL was absolutely critical while I continue to fight the VA for 100%. Today I received my informal findings 70% and placement on PDRL after seeing all the TDRL reductions from the forum over the years I was scared to death this whole time until this morning. The importance you placed on making sure your re-exam goes well was key to me keeping my 70% DOD rating.

On a side note, most of the Vet and Retiree organizations are pushing to get H.R. 333 through Congress that would give Chapter 61 Retirees Concurrent Receipt who have less than 20 years of service. Now I'm glad I listen to you pestering everyone fight for the highest DOD rating as potentially it can result in you getting thousands of extra disability retired pay a month. I wish you the best of luck in the adjudication and conclusion of your case and I hope it is fully favorable best wishes and thanks again.-Nick

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer!"

DoD Legacy PDES (Post-DoD IDES MEB/PEB) case status:
Due to positively proactive measures on my own behalf, the third periodic TDRL medical examination for PTSD is completed via an Army Military Treatment Facility; this is even earlier than originally scheduled (May 2018) and rescheduled (July 2018) by the USAPDA. The TDRL PEBLO shall forward all records pertaining to my TDRL to the nearest USAPEB for adjudication of final TDRL findings. Currently awaiting the USAPEB's final TDRL findings at this point in time.

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer!"
