I was medically retired (90%) back in Mid October 2024. (I receive around 85% because my time in service was greater than the 75% limit.) A reservist on active duty tour with more than 20 yrs active duty. A month after retirement I received notice from ABCMR that my request for relief had been found in my favor adding 80 days of active duty to my points total. I now have 12,418 credible points. I requested the RSO at ft Sam to recalculate my time. Well, they said they would touch it until I had DD215s for all my DD214s and new 5016 points sheet. Well, I finally got all that to them back in April. Now they have gone radio silence on me. I’d pay them a visit but I’ve been out of the country since mid May. I questioned their calculations because they pushed back on account that even though we added 80 days active duty, the new calculations on the DD215 took away 4 days in total. Meaning the last 214 was 84 days too much. But, my total points went up like 60 points. This appears to have created a problem for the RSO.
I was 57 yrs old when I was retired. I have more than three years of active duty orders credit for reduced age retirement so on the day of my retirement I could just have easily qualified for reduced age retirement.
So, two questions.
1. If a reserve component soldier is medical retired does the soldier have to wait until age 60 to receive medical retirement pension?
2. As a reservist would I not qualify for a non-regular retirement pension because I’m a reservist- no matter how many active duty years I have?
What I’m trying to figure out is why doesn’t the RSO just take my points and divide by 360. What appears that they want to do is treat me like active duty and take the total time from my active duty, final 214/15, and then add the 1405 points after.
What am I missing, what is the most beneficial?
