YetAnother Admin Action/ MEB Question

**Update** LOL - well the waiting for SOMEONE at AFPC to go...E-3 now E-4 and date of rank is, finally ended. I "should" be expecting orders Monday or Tuesday, and can NOW finally go BACK to finance and request they pay me the money I paid them back, and then some, for the back pay to SrA rank......errr wait, NOPE didn't happen that way, what did happen is I got my rank back - but the date was the date the Demotion Authority granted my appeal. Except my appeal requested the original DOR back to June 2011. They agreed, and so did local promotions office, so NOW - I should still be expecting orders Monday or Tuesday, but can't go to finance until I get back from house hunting PTDY or Leave, until this is changed. I swear the USAF has nothing but part-time, care-free, workers anymore. I totally respect those that do help, and go out of their way like my shirt did on Wed, and Thurs to get these situations resolved, but man it's the other percentages of people that really make this process unfathomable.

UPDATE-**ORDERS**

Kinda, the Virtual MPF page now shows my Retirement-Outprocessing checklist available and ready to be accomplished with a date of 29 Oct 2012 as my final enlistment date. As I was gone from work already this afternoon, I can ONLY suppose that means my orders have come through and I'll be speed racing (at a slugs crawl) back to my home of record as soon as humanly possible to start my search for a house. *Hoping to leave Thursday 0000 if I can get my permissive tdy or leave approved. SO - that leaves me with the great great news of FINALLY!!!!

UPDATE-**SSDI**

I received a vocational rehab packet in the mail from Social Security asking for my last 15 years of job history. I called them back to "question" if this was necessary as my last 8 were in the military and I didn't think it was needed. The individual perked right up without any leading on my part, and said yes Mr. Snuffy, even with your packet being processed under the wounded warriors program it was standard practice to have this done, so they can rule out possible work roles you may be or have been qualified for but unable to do since your injury. Additionally, I told him I maybe know 2 possible 3 of my last jobs but dates, wages, all that good stuff I had no idea, he said it's ok. If i didn't know put Don't know, and move on, just that if you know you did some type of work, make sure it's explained as to the type, lifting, bending, etc etc, so I filled it out had to go back to 1996-1997 - yeah - I couldn't remember all the misc jobs I had as a teenager/early 20's. I job hopped for quite a bit till I joined the Air Force. Either way, completed, and mailed off yesterday!

UPDATE**When it Rains it Pours**
SO, my stroke of good luck didn't end there, received an email in the morning, telling me that my Date of Rank had been accurately adjusted back to June 2011 - and it had - and that a special expedited notice had been sent to DFAS to have this adjusted correctly *with back pay* by Sept 15 pay period. The email contained the addressees and all appropriate documentation/screen grabs of the "system" showing this request for fast processing, and correction.

I am ecstatic now as this is finally moving in a somewhat resolute direction.
So can't wait to be done with the military bureaucracy portion and be a civilian fighting the good fight once this is finished!! SOON, my friends, SOOOOON!

I hope this happens to me. My command could have given me my rank back now i have to wait for a rank determination. This could be called fraud waste and abuse. If they gave me my rank back i'd be out 10X faster and not in there hair. LOL Either way congrats again!!

My biggest hurdle today and until next week is that I can't get a straight answer on whether Permissive TDY is approved or not. TO the point my shirt said well why can't this wait till Tuesday...UM Cause their's a HURRICANE in my way after Saturday if I don't get there now, and through my entire travel time making 13 hr car trip probably 28. Either way, she's still adiment that my CC approved my Terminal but didn't say anything about PTDY and it was like pulling teeth to get the terminal...Her words, so How I can have an approved terminal then be forced to take my own leave to find a house, then NOT have terminal since those days were used as ordinary leave vs terminal LOL - its good they find this all to be a huge joke to F - my arse, but it's not funny anymore!

how do you plan to be gone that quickly without outprocessing the base? you will need to have a shit ton of briefings (1 day tap, finance briefing and outprocessing on top of virtual checklist, etc etc) and then have a final out through mpf.

Where does it say I need to do the out processing before I go house hunting? AND I Don't want terminal leave. I've got 2 months the first month spent doing what I need to do to find a house, second month - outprocess the base - I've already done every outprocessing thing you can do without orders - and took TAP - twice now - once last year and once this year - as ordered by my leadership to ensure I was ready when they kicked me out. I understand the briefings and what not - I've been active duty for 8 years, and have outprocessed a few bases in my short time =P so i get it - I'm just unhappy with my CC and his continued F'U under the guise of Commanders Discretion - denying me PTDY for house hunting serves no purpose other than to say - I still have power over you and I'm not granting your requests - as he has done for over a year and a half now.

Additionally, denying that permissive but then "granting" terminal?? Before orders, but only after the shirt plead with him? these folks have been in the Air Force a lot longer than me, and they know what is right and wrong, and what should/shouldn't be done, - How do you grant terminal before someone has orders? How does terminal work, now that if no PTDY, I use up those same days that were already "granted" for terminal as ordinary leave? catch my drift here?

oh i outprocessed pretty quick too, but it still took a few days because some of the briefings are only offered certain days. make sure you have done the finance outprocessing checklist to go with the virtual one. also check your orders thoroughly, i had two issues with mine and had to contact afpc to get them fixed.

As of today, AFPC has finally recieved my admin actions documentation after a month of waiting! so it will now be given to the medical POC at AFPC for their review and final recommendation; timeline (they say) is expected to be 1 to 2 weeks. does it still have to go to SECAF after this
 
I do not know if the SECAF even has a timeline *published or not*. I can only say this - if the case has to go to the SECAF for any reason in the decision process for admin sep vs. retirement - They "should" be doing the grade determination automatically at this time. Each case is different, and I know mine was pretty quick once it finally went to that office. As posted earlier on this thread - I got my SAF ruling 10 Jul 12 - (Dated 3 Jul 12) since my case was Dual Action (Medical Retirement or Admin Sep). This decision came down approx. 30 days after I signed my AF 1180 and got my AF 356 back from the IPEB (6 Jun 12).
**Additional Update**
My permissive TDY has yet to be approved but is expected today (the decision yes/no anyways) But I can't leave on Tuesday as requested, as my orderly room has "been trying to reach me now all week" and finally "got a hold of me on the telephone yesterday at 1700hrs" - That I need to report to the Orderly Room before I leave on Tuesday. Well, well all know what that means (DDR - Drug Demand Reduction - Piss Test). But the problem I have with it - is NO ONE tried to get a hold of me - I only had the email yesterday at the end of the day, and since WE work and the rest of the base is off today - I couldn't get it done today, now I have to wait till the early morning/afternoon to leave on tuedsay vs 0000 hrs. as planned. I also spoke to my supervisor and superintendent - and NO one tried to contact me until yesterday at five. So whatever BS they're telling them, they even said well we tried to contact you and your supervisors all week and no on did. EITHER way, another speed bump/F U - I have to deal with.

So instead of directly responding to what was placed in my congressional complaint my chain goes back to 2009 and tells a bogus story of how I'm pretty much a dirt bag airmen and that I've had trouble with 4 units ( all these squadrons fall under this one unit, and the trouble came when the one supervisor I had on my side had to take a medical leave) and that I fail to meet fitness standards even though I have a binder well over a 1,000 pages of documentation not to mention they failed to mention how they came up with they admin action decison. So now I have to dispute the response I'm so ready for this nightmare to end. Does anyone know of a good lawyer
 
So SECAF ruled in favor of admin instead of medical.... how can I appeal this or what can I do to even get my schooling back once my general upgraded to an honorable..

I would want to know more about your situation to tell for sure. That is, what reg are they separating you under, what is the basis for separation, what evidence is in the case file, and what the SECAF decision states.

There are no "automatic" upgrades. You likely will have to apply to the AF Board for Correction of Military Records to challenge this (though, you may have a basis for going directly to Federal Court if that route is preferable.

I received a proposal of by DOD at the end of May of 50% with permanent retirement when June came around and orders was about to be cut my Chain of Command decided to stop that and push for a general discharge under minor disciplinary infractions.
 
I think Jason wants to know specifically. He'll give you advice on what you tell him. You don't have to tell us.

Normally Article 15 = trump your out with nothing
Normally Administrative = Medical trump discharge
From what I've seen but each case is different. good luck!
I've never had a Article 15.... just LOC's and LOR's here and there they waited until the decision came back from my MEB to do a Admin Action against me.... So I'm not even understanding how it goes from a permanent retirement to a general discharge with a proposed rating of 80% from the VA as well
 
OK, so I'm back with some more information/rants.

I had my second epidrual on 25 March, this one had me in so much pain that i was unable to work until the 8th of April. Had many phone calls with doctors and First Shirt whom said he was working on getting me put on convo. Well long story short, I come back to work and have to have a meeting with SMSgt and commander, they inform me i have an appointment with the Squadron commander later that afternoon in Full Service dress blues. Go home change, come back - he's issuing me an LOR for absent without leave and failure to perform duties. I'm just astonished, and it starts for the DAY OF my last epidural thru the 8th. I was amazed. Then got my EPR following week and it's a referral 3. Then same week get notified that the Administrative action against me. Obviously i've seen the ADC this entire time, and the lawyer told me they can do the administrative action against me and nothing to fight it with. EVEN with the current medical condition. So I'm PCM referred to see a Neurosurgeon....FINALLY.... he looks at my MRI (apparently) not with me and tells me in a 15 minute consult 2 hours away drive, that he sees no reason for my pain but orders a mylegram. Talk about worst procedure on the planet, i had headaches for 2 weeks following, and i'm talking debilitating ones. So, 2 weeks later now pushing into May, his nurse calls and informs me that they acknowledge i have a couple of bulging discs with slight nerve inmpingment but there is nothing the Neuro Doc can do for me that would be beneficial.

So next i'm scheduled for a Physical Evaluation by my PCM on whether i can have physical program success. Well i see one of his team members a LT and she's all about saying no not with my current condition but needs to run it by my actual PCM. He comes in and says no way i can say no to this, you've been on an active profile that has exempted you from PT portions you cant pass. IE AC measurment. I'm just amazed at the complete lack of realism here. He again re-interates my pain levels dont match whatever it is I "think" i have.... So I argue with him that it makes no sense that you would say i could still be waist measured and expected to pass since the profile you have me on restricts me from doing ANYTHING - and rightfully so. I asked him take blood since they've not once done that. Oh yeah and PT test and fail on the 25th, bringing my total up to 5 in a row - 2 with the current medical condition.

And they put me in to see ANOTHER pain management specialist (Now June). I'm thinking to my self great more epidurals... Well this guy looks over my MRI with me, and tells me he is 99 percent positive i need spinal fusion of my L5 and thinks it needs to go up to the L4/L3 as well but wants me to have a discogram done first. WOW. He shows me the annular tears in my discs says from L3 up looks normal, from L4 down like an 80 year olds back....Finally some vindication. I suppose, but now have the whole getting demoted, and need to know what to expect from that and with the whole 5th failure yet undiscussed formally anyways with me and my operation yet unscheduled. What should i be expecting now...at this point they've beaten me up to the point i just dont know what to do.

Almost this same thing happened to me and that is why i am now getting an ART 15 for it.

Sorry to hear that Jazz - just document it and fight it the best you can - I'm out now and waiting on the VA to finish up my stuff - I've been finished so to speak since May 2012 - but out of military retired as of October 29th 2012 - Let us know if you need anything!
