PEBLO is not performing their duty

Hey Everyone, I have an ongoing medical situation (4+ years now) and most recently I was placed on Medical Observation for 3 months ending on November 21, 2013. My PEBLO refuses to contact me, take my calls, or do anything further as far as I am concerned. I should not have been placed on the 3 month hold as I had already been on a 6 month hold with an MEB following the 6 months if my condition was not controlled/stabilized. They ignored all paperwork submitted and stated that they needed all of that same paperwork before they could proceed. I reminded them that they had all of the requested paperwork and they decided to do the 3 month medical observation anyway, followed by submitting an I-RILO to AFPC/DPAMM No Later Than November 21. That was never submitted and we are now 2 months past that date.

When I have gone to the PEBLO office, I am told the PEBLO is not there. My calls are not answered and my emails are unreturned. What is my next step? Who can I talk to? Who is the PEBLO's boss? I looked up submitting an ICE complaint online, but the department I need is not listed. I have submitted letters to my Representative and Senator, but that has not led anywhere as of yet. Any help would be much appreciated because I am now awaiting retraining, but unable to retrain due to "Pending MEB" and have been since June '13. I was disqualified from my job, had my reenlistment bonus taken from me, and since I am at a training location (Intermediate training. 10 yr Active Duty) that was over 6 months, I am unable to do any job and am a permanent Urinalysis Observer until all is figured out. I think their goal is to drive me crazy.

I was also incorrectly coded in December so now I am facing the QFRB (and I am only facing it due to my medical, which is complete BS) and nobody has fixed it. They cleared me medically after the 3 month hold with no further appointments and my issue still worsening, but not having that info included in their reviews. Still looking for the PEBLO's boss or who I can place a complaint to. She hasn't responded to over 20 attempts of contact since January.

Did the congressional in February timeframe. Basically led to the medical unit reviewing their own stuff and saying that they are doing everything correctly. I'll re-initiate contact since things have since worsened.

Have you tried contacting the Airmen and Family Readiness Center? They may be able to refer you to the correct agency.

On a side note:
This situation is crazy as nobody seems to handle it or know what to do. ADC won't help because I am not in trouble. IG won't help because it all stems from medical. Med Group won't help because they only care about covering their own a--es (not sure if foul language is allowed here). I wanted to submit an Article 138 to my Commander because with the Quality Force Review Board she recommended "Do not retain" even though I have no negative indicators nor have I ever had disciplinary action in my 11 years, but the board falls under a higher level administrative decision so I can't even do that. They keep recommending retain when it comes to the MEB stuff, but decide to choose not retain for this board. I'm considering an MEO complaint as I feel like the only reason they chose do not retain was due to medical and this isn't a medical board. Using that against me but recommending someone who got a DUI to be retained seems like disability discrimination.

The journey continues.

The problem with MEO is that disability isn't a protected category for military only if you were a GS. I went the same route as you and got nowhere, but my beef was with the VA. There is branch of the IG that handles the hospital, I'm not sue how one would contact them, but since they are respectable there is an IG. You might try the patient advocate.
 
Find the patient advocate in the med group. It's normally an extra duty for someone in each section with one or more hospital-wide patient advocates. I ran into problems with my mental health counsellor threatening me as well as PEBLO problems and went to the head patient advocate over my concerns. I got the counsellor fired and a meeting with the Surgeon General over the whole PEBLO issue.

If all that fails then consider reaching out to Jason for some legal help. Best thing I did during my board was to hire him - one letter from a lawyer and next thing you know I'm priority #1. Best of luck to you!
 
What's sad is...many peblos have jobs wherein they are never held accountable! It's happening to my daughter in the Air Force. We contacted the Commander and First Sergeant. They seemed to get some better results but what a "skater" the lady is! It seems they place people in these key positions with absolutely no worthwhile qualifications at all! Best of luck!
