Question @ Bliss

Good afternoon,

Below you will see my scenario and I am asking for some advice on what I should do.

19 years 2 months time in service (20 Feb 2023 is 20 year mark); Service Remaining Requirement (SRR) for last promotion ends on 1 Jun 2023. It is my understanding that if found unfit that the SRR goes away.

Current BH provider is floating the idea of putting me in for an MEB for PTSD/Mental Health related issues. Just moved to a new unit and they want to work me until the last day before my CSP Internship (4 Dec 2022); including sending me to NTC mid-Sep through mid-Oct.

What should I do? Should I have the provider execute the P3 now or wait for later down the road?

If you can have it wait I would wait. The process can go quickly for Army personnel. Ask if they can delay the P3 until September if possible. Right now it would be hard to delay it to get to 20 years. If you can get it done at 6 months out then you should easily have everything delayed enough to reach 20 years. Also, if found unfit you would not have the SRR anymore. Also, I would start talking to some dedicated private attorneys. They aren't cheap but if you work with one from the start you have a better chance of achieving the outcome that you want.

So, I should talk to my provider to see if they can wait until I am six months out from my 20 year mark? What if they want to initiate the P3 now and the IDES process is completed prior to 20? Is there an courses of action to get me to my 20?

AR 635-40 CH. 6; Continuation on active duty (COAD).
AR 635-40 CH. 4-29; Retention of Soldiers with more than 18 but less then 20 years of active service.

I think you’ll be ok when it comes to attaining 20 years AFS. However, know regulations that will inform you of your options to hit your 20. Too many Soldiers settle for what they believe is the only option when it comes to accepting a medical retirement so close to 20 years. Your retirement pay is significantly different and depends on it. Know your options Ranger Buddy!

@CrustyGrunt, I am definitely looking to get a check for Army retirement and from the VA.

Would you say it would be ok if my provider initiated the P3?

I would delay if possible. But if it’s initiated those regulations give you a few different routes to attain 20 years AFS. Not sure how it would impact your CSP. I’m not too familiar with those regulations. If you start the MEB you can appeal and delay the process as well, and if found unfit you can apply for COAD or differ your disability disposition until you attain 20 years of AFS. Plus the MEB should get you out of going to NTC. Get familiar with the MEB process and read up on the regulations. If hitting 20 years AFS is the hill you want to die on, then do it, fight for what you’ve earned.

I plan on submitting my retirement packet to Ft Knox on 1 Jun 22. Should I turn that in and once approved get the MEB initiated? Just trying to cover all of my bases. I am definitely going to get to 20 years AFS. Getting a CSP is not a deal breaker; that is just a newer thing that I know the Army is doing. It is an Internship program that you can start at the 180 days from ETS/Retirement. I know it is only a few months but I want to ensure I get out with what I deserve and start being compensated as soon as possible after discharge.

The retirement packet will help especially if approved prior to initiating the MEB. You have the right mindset. Always be a step ahead and have a COA for every potential issue. Forward thinking is very beneficial.
