I am transitioning out and was recently given a 50% DOD rating and a 100% VA rating. I was told that my re evaluation for TDRL will be in April 2023. Is this a re evaluation of just my TDRL rating (and whether to place me on PDRL) or will it re evaluate my VA rating as well? I know if I am 100% P&T with the VA I prolly won't be re evaluated, but how do I know if I'm 100% P&T with the VA? I have a letter from the VA with proposed ratings since I'm not officially out until October, is they're any where I can look to see if I am?

Go to va.gov and download your benefits summary letter it should show whether you are 100% P&T

Hello @molb33

If the VA award letter received in the mail shows you have Chapter 35 benefits, you are rated permanent and total.

Am I eligible for education benefits?

You may be eligible for VA education benefits (Chapter 35 benefits) if you’re the child or spouse of a service member and one of these descriptions listed is true of the service member.
One of these must be true:
  • The service member died in the line of duty after September 10, 2001, or
  • The service member is missing in action or was captured in the line of duty by a hostile force, or
  • The service member was detained (held) by force while in the line of duty by a foreign government or power, or
  • The service member is in the hospital or getting outpatient treatment for a service-connected permanent and total disability, and is likely to be discharged for that disability. A service-connected permanent and total disability is a disability resulting from your service that doesn’t go away.

That's the thing, since I am still in and haven't even started terminal leave my ebenefits nor va.gov has been updated. Both still stay"pending decision approval" despite already having my ratings. However, I did read through my proposed ratings breakdown and found this:

"for purposes of entitlement to department of veterans affairs (va) benefits, it is proposed to grant basic eligibility for dependents' educational assistance. the effective date that will be assigned at the time of the final rating decision will be the day after your release from active duty as you submitted your application for compensation within one year of separation from service. (38 cfr 3.400)"

The only persons eligible for chapter 35 benefits are, at minimum, 100 va disability p&t recipients. So I think I am based on the verbiage in my ratings breakdown.

Hi,

Yes, as I said (posted).

Good luck,
Ron

TDRL exams are only for TDRL. DOD and VA processes are managed separately in this sense.

Hi Ron, I have a question. I was medically retired (TDRL) in June. On my LES it showed twenty years TIS. I had 15 Active, 3 reserve and 2 IRR. I have one combat deployment. I was rated 100% VA and 70% DOD. Have not yet submitted for CRSC. Single never married no dependents. I thought I would only be receiving VA check on the 1st, but I also received a check from DFAS RET (much smaller amount). Does this make sense based on my situation? Is this CDRP? I thought I had to have 20 Active for that?. Just trying to understand this. Thank you.

More than likely your your 70% DOD amount was slightly higher than your 100% VA compensation meaning after the VA offset you had a small amount of money left over to collect via your Chapter 61 pension.

Thank you Provis. That was what I was kind of thinking, but everything I was reading seemed to say there is no concurrent payment of retirement and VA so I just thought it had to be one single check from VA.

It is for most. It depends on a lot of factors. Typically those who are higher rank and have been in longer are the ones that get some $$$. My wife was retired at 75% DOD as an O4 with just under 17 years active duty time and she expects to receive several thousand from her pension even after the VA offset.
