CRSC and Brain Tumor and Sleep Apnea

Has anyone been approved or denied for Brain Tumor and SleepApnea for CRSC?

Brain Tumor reported as part of the burn pits and if your exposed to radiation. I fall into both.

Sleep Apnea test before deployments negative
Sleep Apnea test after 3 deployment positive

Medically retired for Brain tumor. Both conditions service connected.
 
I don't know of anyone personally, but seeing that PACT was just signed a couple of weeks ago, it's not surprising. However, since "Brain cancer" is first on the list as for being presumptive, and if the VA coded your sleep apnea as secondary to the brain cancer, then both should be approved for CRSC. Just my opinion.

Brain tumor would fall under presumptively? Additionally, the conditions that were rated for the tumor were migraines @50% , left cranial nerve palsy @20% and right cranial nerve palsy @20%. These were also the conditions I was medically retired for as well. Will the Army look at these conditions the same as the VA as presumptively and see that I have tours to Afghanistan and Iraq as well as info in the burn pit registry…..
 
DoD rates unfitting conditions based on service guidance. Conditions secondary to a presumptive condition should be CRSC eligible. You have to apply for CRSC after you retire. You can get your application for CRSC and get it ready to date and file on first day in retired status.

Thank you for that. So I am retired and receiving CRSC, but I did not submit for the conditions associated with Brain tumor. I am curious will the conditions associated with tumor be considered presumptive, granted I have been receiving VA compensation for those? I have my CRSC Claim for the other combat related disabilities, but I was unaware of “presumptive” for the Brain tumor. Retired in 2017, never submitted documents supporting my tumor….
 
You can submit an applications to your service. They can add on conditions, without review of previous conditions awarded CRSC.
 
For CRSC the service will use the VA percentage. Disregard the part about unfitting, that ship sailed.

The answer to your question is no since you do not have 2 of the 4 conditions as noted:

ONLY if the VA rated them as "secondary" to the tumor, otherwise "no". The VA has to clearly state this in your rating's decision. The way you will know this for certain, other than the word "secondary" being in the description of the condition, if you have a VA code sheet, if something is considered "secondary" it will be listed immediately following the main diagnosis. I.e.

Brain tumor,​
Incurred​
Migraines, 50%​
Secondary​
Obstructive Sleep Apnea, 50%​
Secondary​
Left cranial nerve palsy, 20%​
Secondary​

Obviously, I am just winging it above, however, if you want to shoot me a redacted copy of your VA code sheet (if you have one) or your ratings decision memo, I can let you know rather quickly.
 
The language in your DoD document posted above, should motivate you to file for CRSC TODAY. Th.ere is no reason to delay. Ask and you shall receive.
 
Any follow-up on this? I was diagnosed with a brain tumor in 2022. Currently working through the FPEB process. Already got initial DoD and VA ratings of 100% (Iraq vet). Trying to convince the formal PEB to change to combat-related in hopes that will increase my chances of being approved for CRSC. Any thoughts/suggestions out there?

It's 2 different set of regulations that each entity uses. Its very common for CRSC to be granted even though it wasn't deemed combat related by the PEB. My wife argued presumptive due to the PACT act for combat related for her 50% chronic sinusitis and the FPEB didn't rule in her favor to over turn it. Your chances might be super slim since the guidelines for CRSC are broader and cover more things than those same guidelines that the FPEB uses.

BTW, when my wife applied for CRSC she was granted 50% rating for that same condition.

Just wanted you to know so you don't think you need the PEB to rule it as combat related to then get CRSC after you get out.
 
And...there are thousands of retirees who did not receive a disability retirement (or PEB processing) who receive CRSC.

I am one of the thousands.
