Navy Terminal Leave - DOD Inst 1332.18 Vol 1 - Table 2 on Page 39 states Service Member Transition is 26 Days, EXCLUDING ACCRUED LEAVE - Terminal Leav

DoD Instruction 1332.18 Vol 1, Table 2, PG 39, states service members have 26 days for transition, EXCLUDING ACCRUED LEAVE aka terminal leave and PTDY. PERS by instruction is supposed to write disability retirement orders so sailors can take: “106 days” 26 days transition, 60 days terminal leave, 20 days PTDY! PERS-9 knows this but is ignoring this instruction which they claim is their bible and only authorizes sailors 26 days. This is a huge issue and for me is a ~$40,000 loss since I will lose the leave and cannot sell back any more leave!

Man the Navy sucks! The Army sets everyone out 90 days but if you need more time to use all of your leave they will amend the orders and move back the date to ensure you can use all of your leave before retiring. All it takes is a 4187 form filled out with an O6 signature.

By doing this they standardize the process but allow for changes in the odd case where a Soldier needs to retire later to allow them to use all of their leave.

There are multiple other references that direct the Navy to place special emphasis on granting maximum terminal leave for disability retirement, here they are:
MILPERSMAN 1050-010, Leave Policy, section h.
*Special Emphasis on granting leave
OPNAVINST 1900.2B, TAMP
*Authorized PTDY for TDRL/PDRL
MILPERSMAN 1050-0120 and 1050-0400, Terminal Leave use and sell
back
*Authorized 60 Days Terminal Leave, you can request more for special cases.
*1050-0400 covers selling back max of 60 days over a career.

Yeah I believe the Staff at PERS is pressured to reduce the IDES/LDES timeline and by not allowing sailors to take terminal leave and PTDY it cuts the timeline by 80 days!

It’s Wrong to cheat the sailor to make your program timeline look better!

I hope PERS starts following existing policy and directives so sailors can use their accrued leave!

This is probably one of the times where a congressional inquiry or IG complaint might move the needle for him.
 
I can neither confirm or deny the Navy IG confirmed they are contacting PERS this week. As a complaint about that would have merit. ;)

Wrong call as this has huge financial implications for families, sailors, as they transition.

41+ years of active duty service and only 2nd time I’ve had to elevate an issue to the Navy IG. Hate to do it but sometimes working things bottom up does not work.

I’m about to submit a VARR and the PEB should be wrapped up after that and my leave balance is 75. My command has no problem granting all of it but how do I notify PERS that I have that much leave and want to use all of it so that I get a retirement date that will allow me to use it?

The AF made it simple. They calculated my date to include terminal leave, PTDY, and time to outprocess.

Any updates to this? I'm going through the process waiting for the VA to finish their ratings. I know the PEB has found me unfit. I have surgeries and procedures scheduled, and need to know my retirement/separation date so I can ensure all of it falls in the timeline, I have some leave on the books that I'd want to use for terminal, etc. Any knowledge/insight you have from the process that I can leverage would be useful.
