  • 1SG_G,

Glad to hear you are in remission. It is hard to tell exactly what is going on. That is, it is not clear why you would need an MEB if you are in remission. I am guessing that it may have to do with your profile and ability to perform your duties. Are you able to work/perform MOS duties?

If your MEB is initiated, then you cannot put in for retirement. I would talk with your PCM about this and your S1 shop to see their take. COAD is a possibility, but will depend on a number of factors including your health status, your support from your chain, and your ability to perform MOS/Soldier duties. I don't know how these factors may play out in your case. But COAD is something to consider if you don't get a fit finding.

    Hope all goes well.
    1SG,

The regulation states, "Note: The 100 percent rating shall continue beyond the cessation of any surgical, radiation, antineoplastic chemotherapy or other therapeutic procedures." So, it is arguable that as long as you are on the drugs, you are still on a "therapeutic procedure." Whether this would be successful would depend on the facts and what the PEB states in response to this argument. This is not a clear cut issue, so, I would want to have a stronger "first plan" for arguing for a high rating, if possible.

Glad to help, taking care of Soldiers is a life-long commitment. Pay it forward if you have a chance. Best of luck!
    1SG,

The formula for those with less than 20 years is percentage awarded (by definition 30% or greater) times retired base pay (High-3). It is not necessarily 50%.

If you can stay till 20, then you will be eligible for CRDP. If you are still within the 6 month window for cessation of treatment, you will be rated at the 100% minimum level for your condition (though, in all likelihood, you will be placed on TDRL for re-eval until you are actually outside of that window, unless you hit the 5 yr TDRL limit, in which case they have to retire you permanently if you are within the window at that point (the last is my opinion of what they must do, not sure they feel the same way)).

Past the 2013 date, the CRDP phase in is complete, you have full restoration of retired pay, to the maximum extent permissible. You do not lose the VA benefits.

    Best of luck!
