100/100 dod/va how can I get retired?

Ok, so I am a little lost. When we got back from our last deployment in 2015, we got RIF’d because our Brigade was disbanding (2-16 Rangers... ) I was in the process of an MEB, but this took priority. I got a good severance of which I’ve paid all back to the VA. At this point I got 100% DOD rating and had to serve in the guard to get my severance. During the first year in the guard, I got 100% VA combat service connected (not p&t yet) (11B/38B and 4 year DS) and was ultimately medically discharged from the guard (2018) due to this and another combat related diagnosis that the VA has yet rated me for. So, since I was rated 100% by both entities and medically discharged, how can I get that turned into retirement status?

This form is what you file with the Army. Based upon your narrative you would want to ask for a correction to the discharge that you were given by the guard. The goal would be to submit the form with evidence that makes the boards decision easy. Often folks will consult with an attorney to review what they want to submit.

Without knowing all of your details, I think you would want the board to look at the Guards decision to discharge you rather than submit you to a MEB/PEB.

Well, it is important to demonstrate that there was an injustice. Page 3 of the form I linked you to has a basic example in it.

Ok, I’ll just have to figure out a work around. I have the example. If they do “retire” me, I get the same VA money, but a retired card and Tricare for life, that’s about the only difference, correct? Sorry for all the questions. I am trying to do this and get my ph paperwork in order to submit it too

You will get Tricare for Retirees until you have Medicare, at that point you would be eligible for Tricare for Life.

A medical retirement would also open the door to potentially obtaining CRSC if your branch of service approves it.
