19 years TIS AD...MEB starting soon

I have many issues, but the most recent, mental health is driving an MEB. I am a prior enlisted officer. 15 years enlisted and 4 commissioned.
1. What are my chances of an approved COAD application to get to 20?
2. If I am medically retired but make it 20 yrs before it closes out do I qualify for CRDP?
3. what happens if I don't make it to 20?
4. Would being an AFW2 member help at all?
 
1. Very little chance. COAD is a last ditch effort to be kept in after they determine you are unfit.
2. No CRDP if you don't hit 20 years. Its a very big deal that you drag it out to hit 20 years.
3. No CRDP & if rated under 30% no retirement and no Tricare. Just a one time severance check that will be recouped by VA disability.
4. Not sure. Sounds like a great program but would only help if they can help delaying.

Now what no one else will tell you... This process is fraught with pitfalls. 2 people having the same conditions and symptoms can have very different results based on their knowledge of it. Also, if medically retired without 20 years your best case scenario is TDRL for a mental health unfit condition meaning they can still lower your percentage down the road until it becomes PDRL. I HIGHLY suggest you hire a private attorney to help you strategize. My wife hired one and she was at 19 years. With the attorneys help she was able to hit 20 years and 2 months + other benefits she never dreamed of getting such as having her pension exempt from federal income taxes. They are not cheap but just like the criminal justice system those who spend the money on a qualified attorney from the start tend to have better results than those who use public defenders which in your case is assigned IDES counsel.

high 3 = $7165

VA @ 100% = $3745
50% longevity = $3582
75% disability = $5373

5373-3745= 1628 residual

3582-1628 = 1954 CRDP

Total = 3582

VA = 3745



Total pay = $7327

For CRDP its pretty easy. Take your longevity + VA compensation to equal total. So the disability amount percentage isn't needed for the conversation for CRDP in most cases. Those calculations look correct.
 
There are many threads on here with similar situations and how to drag the process out. There are at least 7 levels of appeal, you’ll want to use all of them, doesn’t really matter what for, just find a reason any reason and appeal. Then take all the time they allot you for signatures at each stage and use up all that time. Also save all of your terminal leave. I recommend reading up on all of these and be prepared and as mentioned above, seek good Counsel.

i have not contacted an attorney yet. my doctors are willing to hold off a bit to ensure the MEB process gets me to 20. 1 Aug of 2023
