Am I CRSC eligible?

Hello all,
A couple months back a guy a work with mentioned I might be eligible for CRSC. I am new to the forums but have been scrolling through for a couple months now trying get answers. So, I started looking and asking any VSOs if I am eligible, none of them had any clue what it is. A little back story on my situation I was in the National Guard for 10 years with a deployment and 6 years active guard. While in country I was injured and all of it was documented. During demobilization I was seen at the VA hospital for my injuries they also started paying me 40% disability while I was still receiving drill pay. All that aside I ended up with on a med board and being medically retired. I was receiving 20% from DoD pay and 20% VA pay for almost 8 years. My conditions have worsened so I went back to the VA and got re-evaluated and bumped up to 80% but they took my DoD retirement pay. In January I sent a stack of my records to the Army HR. I do know from this forum it does take time. I am also in process of getting PTSD revaluated which should bump me up to 100%. I guess my question is am I even eligible for CRSC?

Combat Related Special Compensation (CRSC) is a program that was created for disability and non-disability military retirees with combat-related disabilities. It is a tax-free entitlement that replaces some or all of waived retired pay associated with the receipt of VA compensation for combat-related disabilities. VA compensation is paid in full. With CRSC you can receive an amount equal to or less than your length of service retirement pay and your VA disability compensation, if the injury is combat-related.

Eligibility
To qualify for CRSC you must:

--be entitled to and/or receiving military retired pay. In other words have a DoD disability rating of 30% or more.

--be rated at least 10 percent by the Department of Veteran’s Affairs (VA)

--waive the amount of VA compensation from your retired pay (i.e., your retired pay is reduced by amount of VA compensation)

--file a CRSC application with your Branch of Service



Disabilities that may be considered combat related include injuries incurred as a direct result of:

--Armed Conflict

--Hazardous Duty

--An Instrumentality of War

--Simulated War

Can you clarify if this was a typo or not? In order to be medically retired you have to be DoD rated 30% or more
 
It has been so long since I have looked at my original decision, I'm assuming that I was at least 30%. I honestly never really understood my original decision. I
 
I also never understood why they stopped my Dod pay after my new VA decision.

In accordance with current law, a retiree with the number of years service you had must waive retired pay dollar for dollar in the amount of VA compensation received. Otherwise, you could not receive VA compensation.

The purpose of the CRSC you asked about is to replace some or all of that waived/lost retired pay.

Your retirement orders will show the DoD disability percentage and the total active duty equivalent. You might want to have it available for later in the CRSC process.

Copy, I did send that in my packet I was lucky enough to remember all of my iperms stuff. Thank you for your help. I sent my packet in at the beginning of January so i hope I hear or something by the end of June.
 
(UPDATE) I just got my CRSC approved unfortunately I only got 10% for tinnitus. They said that my other issues were not combat related maybe I didn't have enough proof. I dont even know if it worth looking for more proof. I had sent in all of the LODs and statements when I was injured in country. I'm not sure what more they want. Honestly am happy I got 10%.

An injury while in a combat zone doesn't in itself qualify. Read up on the CRSC definitions.
