Army National Guard NDR-PEB

Good afternoon, Folks,
I have attached a pretty lengthy PDF to keep the post itself short, but I wanted to provide as much relevant information as possible in order to try and get the best possible answers. The names of the folks involved in this will be redacted, and billet titles will be provided to provide clarification and anonymity. After the sequence of events have some questions regarding my understanding of the process in relation to the corresponding regulations, whether or not my understanding is correct, or if there's anything I'm missing. My intention with this is not to get legal advice, but to get an opinion from those with experience in these cases as to whether or not what's going on is correct or if there is anything that seems suspicious or against regulation like I suspect.

I feel for your situation. It seems I hear this type of situation too often with NGB/Reserves. Please reach out to JAG asap. They were able to make sure that my N-LOD was corrected in time. I only had good experiences with the JAGs I worked with but this is not everybody's experience. Remember that this is your career and the rest of your life. Don't let the system just process you through without fighting for what you deserve.

Damn that was a process. Well first I want to congratulate you on being able to fight against the nonsense and receive your retirement.
I'm glad for my sake that this seems like a length process, because one of the case managers told me in June that this was a quick process and I'd most likely be discharged at the end of July, which obviously hasn't happened.
What my biggest issue right now is that at the time I was placed on the permanent profile and received the notification of intent to separate, the adjustment disorder was the only diagnosis on there, and they said it was non-duty related and I elected for the NDR-PEB, which is part of the Legacy Disability Evaluation System IAW AR 635-40. However, in the Enlisted Administrative Separations regulation, it specifically states that for "chronic adjustment disorder" (which is what is actually what's listed as medically disqualifying in AR 40-501) it requires referral to the Integrated Disability Evaluation System.
After the fact is when they threw on my profile that I have bipolar disorder, which I still don't have a clear understanding as to why because I've seen four behavioral health providers since November, 2021, all of whom never diagnosed me because I have no history of mania/hypomania/major depression to indicate a diagnosis, and MedDet has all of my behavioral health records so they know I don't meet the diagnostic criteria.
