Being sent straight to LDES as AGR soldier?!

Received first correspondence today after being told that a MEB was being intiated for my husband that he is being processed through the "legacy AGR MEB process at Ft Meade" and "DO NOT submit a MEBTO packet for this MEB referral. This IS NOT a MEBTO MEB."

We are AGR and it was my understanding from reading here and elsewhere that we would automatically be placed into IDES not LDES - or at the very least that we would have to elect to opt into the legacy system and sign off on that.

I've found the DoD policy stating that it should be the soldiers election and we are prepared to politely challenge this and ask for clarification as to why we are being automatically processed into the legacy system and why "this is not a MEBTO MEB"?

Does anyone have any insight on this or if this is possibly the right COA?

PM me your email address and I'll send you the applicable AGR regulation. Your Soldier can take that regulation directly to his CoC to educate them (there's an art to this), or you can just have IDES legal take care of it. LDES is voluntary, requiring the Soldier to waive IDES, a signed memo from the Soldier's Commander recommending IDES, and also requiring approval by the attached MTF Commander. So three people must all agree to it, the Soldier, the Commander, and the Commander over the MTF (which the IDES is affiliated with). There are some unusual exceptions for initial entry Soldiers which does not sound like it is the case here.
 
Your husband may want to talk to the Army's Office of Soldiers Counsel. They can educate leadership on your husband's behalf and also provide your husband guidance.
