-- gross retired pay from the DFAS RAS $888.09
--I was approved for 40% DOD in my medical retirements. (lumbar back and radiculopothy)
-- my Disability retirement: 06 Year(s), 01 Month(s), 06 Day(s), it says on orders my Basic Pay: 13 Year(s), 04 Month(s), 09 Day(s)
--I receive 70% VA with is $1717 with spouse two kids (this may go up to 90%)
--Approved 40% CRSC per my SF199. although the VA has added secondary conditions to my back like insomnia and sciatica since the DOD did there paperwork. So i may be 70-80% CRSC as there was an LOD filed)
--I don’t qualify for any other retirement and I did not transition to the Blended Retirement System.

Since I have more condistions beign rated by VA as we speak is it possible the CRSC can be higher since I am now havign secondary conditions to the reason i was kicked out for, primarily insomnia, sciatica, and increased radiculopothy. how does that effect the math?
 
i don't know my high 3. i was never given this information but I was given 40% DOD Chapter 61 and SF199 said following;

Disability is based on injury or disease received in LOD as a direct result of Armed Conflict or
caused by an instrumentality of war and incurred in the LOD during a war period as defined by law:
YES

Disability resulted from a combat related injury as defined in 26 USC 104: YES

Disability incurred in the line of duty in a combat zone or result of performing combat related
operations YES

2. 6.083 AD years x 2.5% = 15.21% longevity multiplier
3. 2220.23 x 15.21% = 337.69 longevity portion of retired pay
4. Your CRSC will be the lesser of
--337.69
OR
--The amount associated with the approved CRSC percentage. The amount is found in the VA comp tables.
Note: It is very likely you will receive 337.69 since that is the maximum allowed by current law (i.e., the computation)

Ran the numbers. You are capped out at $527.35 for CRSC. That's due to your longevity so increasing from 40% CRSC to higher amount wont increase compensation for CRSC. @RonG

not sure if it matters but 80% VA pay with spouse and two kids is like 2108 or so, not sure if that helps my case or not?
So the cap is based off YOS not fact my CRSC percentage should go up cause of increased ratings and secondary conditions?

Answer: Yes. One of the CRSC ceilings is the longevity portion of retired pay using active duty or active duty equivalent.

80% VA with spouse and 2 children under 18 = 2,035.43 + 73.00 = 2108.43 (not provided in original post)
Gross pay from the DFAS RAS $1387 is reduced to zero by the amount of VA comp received. More VA compensation does not increase the amount of CRSC you receive.


"Approved 40% CRSC per my SF199." Your CRSC must be approved by the CRSC board of you service.
CRSC: 40% with spouse and 2 children under 18 = 801.28 + 36.00 = 837.28 CRSC in the case presented
However,
The computed longevity amount and CRSC ceiling in your case is:
527.35 (note: I did note re-compute the longevity amount)

In this case, CRSC will never be more than 527.35 except for COLA increases. It could be less (example: if the CRSC amount associated with the board approved percentage is less than 527.35; that smaller amount becomes the CRSC.

Note to @Prvois : Again, nice job. The only problem I see in using the calculator is that the formula is unseen in the product produced; consequently, one has to re-compute the case manually in order to explain the mechanics involved.

Note to @jeffery_BAMA : This is a simplification, but in general, CRSC for a CH 61 retiree usually is the lesser of the
--Longevity portion of retired pay
or
--The amount associated with approved CRSC percentage...using the VA compensation tables.

thanks - I had a VA Rep (Disabled American Vets) compute and they came up with around $575 however they won't tell me HOW they got the number, so I am thankful you laid it out. I am hoping i get the crsc rating figure vs the longevity but even if it ends up being $527 i will be happy with that. thanks for all you do and God bless you.

Generally, CH 61 retirees receive the lesser of
==longevity portion of retired pay
or
==the amount associated with the DoD CRSC percentage approved. Rates are in the VA comp tables.

I reviewed the info you provided earlier and per your info...you will receive the longevity portion of retired pay as CRSC.

Do they back pay based on ch61 retirement date?
Many do; I suppose probably most. Your CRSC approval letter will cite the effective date.

me again...... not sure if you have been following the Major Richard Star Act or not......it talks about getting rid of the offset and would treat my medical discharge AS IF i had served 20 years. Does that mean if i am 40% medical discharge that I would get 40% of what an active duty e5 get's or "as in" your example above that i would get $888.09 I am a little confused on what it would look like in my case. It sounds like they would treat it as if i had served 20 years so wouldn't i get closer to $1500 a month?

Since the Major Richard Star Act has yet to be approved (to my knowledge), I have not educated myself on its features and the computation.
The House Bill included: "
``The retired pay of an eligible
combat-related disabled uniformed services retiree, who is
retired under chapter 61 of this title with fewer than 20 years
of creditable service, is not subject to reduction under
sections 5304 and 5305 of title 38.''.

I wasn't okay in the head for a couple of years and it wasn't until this June that I applied to the CRSC. I was placed in the TRDL with 9 years and 25 days of active duty. If I get the CRSC, will I get retroactive? Also, to be completely sure, will my computation be at the high 3, times 2.5?

Your CRSC approval document will show the effective date for CRSC and retroactive payment (not to exceed six years).

You will receive CRSC at the lesser (lower amount) of
--Longevity portion of retired pay (active duty equivalent x 2.5% (2% for blended retirement) = longevity multiplier. Average high three base pay x longevity multiplier = longevity portion of retired pay
OR
--the amount for the CRSC percentage approved. That amount can be found in the VA comp tables for the percentage and applicable dependents.

Active duty looks to be 9 years.

Current day average high three: Gross pay on most recent DFAS RAS divided by 70% = average high three today (including COLA increases)

Ron, thanks for computing this back in 2021. My question is IF the Maj Richard Star Act were to pass if the voodoo math you did above is that the "offset" they keep talking about in the bill, would that go away and I would actually get my full DoD percentage of 40% and get the full amount with out all the calculations you did?

Yes, basically. However , I don’t have plans to educate myself on all aspects of the Starr Act until it is fully approved/passed .

Introduced in Senate (02/09/2023) This bill allows a veteran with a combat-related disability and fewer than 20 years of creditable service to receive retirement pay, without reduction, concurrent with disability compensation.
