@Provis will need the info he requested for an accurate computation.

Roughly…

Based on the info you provided
1. 2710/360 = 7.53 Active duty equivalent
2. 7.53 x 2.5% = 18.8% longevity multiplier
3. 5900 x 18.8% = $1109 longevity portion of retired pay and a CRSC maximum.

—2% is used instead of 2.5% if you were in the blended retirement program
—If Army, your active duty equivalent is shown on page one of your retirement orders as: DISABILITY RETIREMENT : XX YEARS XX months XXDAYS

I was rated 100 DOD.

Wouldn’t my DOD Percentage be 100% on the above calculation??

Just asking because I new to this.

nope 100% DOD pays 75% as that is the maximum you can get by law. If I had entered 100% it would have changed it to 75%. I like to enter 75% so that there isn't confusion.

Hello @BlackhawkUH60m

Added: Opps…I misread and thought CRSC maximum was being questioned. My error. RG

Unfortunately, no.

Special Rules for Chapter 61 Disability Retirees: According to law, members retired for disability under Chapter 61 of title 10 United States Code must have the CRSC entitlement limited to an amount that when combined with any military retired pay remaining after offset for VA disability compensation will not exceed the retired pay they would otherwise be entitled to for retirement computed for years of service (i.e., 2 1/2 percent x years of service x pay base).

In other words, the CRSC cannot exceed the longevity portion of retired pay AND any amount in excess of the VA offset further limits the max CRSC for the category above.

So I am assuming that the OP was retired when he was in the NG correct? Does that mean, he gets his CRSC immediately when the audit is done or does he have to wait until 59/60 for NG retirement age? Just curious.

Hello,

1. Nothing indicates he was retired from the reserves/NG. Twenty Good Years are required for a non-regular retirement plus meeting the age requirement.

2. CRSC is payable for disability retirements, irrespective of years served.

3. IF he did qualify for a non-regular retirement, he could apply for it as he approached the age required EVEN if he already has a disability retirement. If his VA is =>50%, he could receive CRDP instead of CRSC upon achieving his non-regular retirement.
