I would greatly appreciate your help with a CRSC computation, thanks for all you do!

Chapter 61 (Medical Retiree)
My high three average is $5375
My approved DOD disability rating is 60% PDRL
I have 7 years 4 months 21 days of active duty
I have 100% VA Compensation, $3227, Married no dependents
I am expecting 40% or 50% CRSC (would like CRSC calculations for both if possible)
I do not qualify for any other type of retirement

1. 7.333 AD years x 0.025 =18.33 % longevity multiplier
2. 5375 x 0.1833 = 985.24 longevity portion of retired pay
3. 5375 x 0.60 = 3225 disability retired pay reduced to zero by amount of VA comp
4. 40% CRSC = $685.73
5. 50% CRSC = $964.36

Awesome, thanks for the reply, 2 quick follow-up questions....

Would the CRSC dollar amount be reduced by the $119 DOD retirement payment I am receiving which is the remainder of my retirement after the $3227 VA is waived? DOD gross pay is $3347 and VA Pay (waived portion) is $3227 so DOD retirement pays $119. I think I read something about retirement pay received above what is waived by VA is subtracted from CRSC payment. If I messed some of the numbers up earlier I apologize.

My other question is once approved for CRSC (example 50% CRSC approved) does this fluctuate with any future changes to your VA rating for the CRSC associated conditions? For example, if you are approved for 50% CRSC today and the VA reevaluates conditions assigned a CRSC rating years down the road and lowers/raises your percentages, does your CRSC payment decrease or is this a one time determination regarding dollar amount/percentage? I'm assuming it's recalculated, just wasn't sure....

It changes based on VA ratings and CRSC approved percentages. I have personally experienced those changes...up and down.

Example: once had 100% for cancer caused by exposure to agent orange. It was reduced six months after the final treatment.
A couple of years later, I had a recurrence of cancer and everything went back to 100%
and now is P&T.

Your longevity portion of your retirement pay is a factor in any CRSC computation since you are a CH 61 retiree.
I did not come up with residual retired pay with the info you provided.
5375 x 0.60 = 3225 disability retired pay reduced to zero by amount of VA comp of 3227.

It appears you have $119 residual retired pay.

"Members retired for disability under 10 U.S.C., Chapter 61, with less than 20 years of creditable service computed under 10 U.S.C. § 1208, and who are qualified for CRSC, on or after January 1, 2013, will have the maximum CRSC payment restrictions. The CRSC payment amount, which when combined with any remaining retired pay after VA offset, will not exceed the amount that is equal to 2½ percent of the member’s years of creditable service multiplied by the member’s retired pay base under 10 U.S.C. § 1406(b)(1) or 10 U.S.C. § 1407, whichever is applicable to the member."

Thanks for all the detailed information! So it looks like the $119 in residual retired pay would be reduced from the CRSC payment [see below], good to know. I think my numbers must have been off. [edited by Mod: Old law was pasted into the thread. Effective 1 January 2013] RonG

I assumed your CRSC payment could be reduced if your associated VA ratings for your CRSC approved conditions were reduced down the road, I just never heard of it happening when I asked around. I expect my ratings to likely increase, but I don't think an increase would make a difference dollar wise due to longevity.

My ratings from the VA and CRSC have been mostly upward.

The temporary rating I described occurs more often than one would think. I anticipated the reduction; it was not a surprise.
