1. High 3 Average: $8508

2. DoD disability retirement percentage. 100%

3. Years and months of active duty 20 years, 2 months

4. VA compensation: 100%, $4871.19, 100% and SMC-S (100% + 60% additional), Spouse, 4 Dependents.

5. I haven't applied for CRSC

6. CRDP eligible, though, not yet processed.

My first retirement check was processed as part of a 75% DoD cap for a total of 6381. My final VA award isn't yet complete.

I know this will adjust for CRDP, or whatever the new acronym is to describe concurrent receipt.

So, here's my question. I know my DoD retirement will adjust down as the VA award goes through to strictly longevity + VA disability. Is there an advantage to applying for CRSC or am I just better off leaving a sleeping dog, sleeping.

I've attached the important parts of my corrected VA findings.

As I always say, I am not an CRSC expert (especially for those over 20 years), so I recommend waiting on one of the gurus to give you a better answer.

But with that said, you will be maxed out in compensation. Your DOD retirement should be 4254.00 per month. If you somehow how that you'll be eligible for 100% CRSC, I recommend applying since that would make your DOD retirement amount tax free.

If you apply for and are approved for CRSC, DFAS will pay whichever is higher unless you tell them otherwise.

You are for sure capped on gross total income. If your chapter 61 pension had one or more condition determined by the PEB as combat related your chapter 61 pension is already tax free and so is your VA. Meaning you have no income to convert from taxable to non taxable via CRSC. So if the answer is yes to combat related unfitting condition then you are maxed and CRSC will not have any benefit. If the law changes in the future you can alway apply then but if I were you I would not bother applying.

They didn't make any determinations for combat related at all, and with the income bracket of my new job, the tax implications are worth probably 12-13k annually. Thats the primary reason I want to at least try for it, not to actually restore any benefit.

Okay so you didn't have any conditions found to be combat related. Since you only get one of the other via CRSC or VA concurrent pay you would need your CRSC to be approved at the same amount as your VA total % to include SMC's, Aid & Attendance etc. If you are in a high enough tax bracket maybe just maybe you could accept CRSC at a bit lower amount and come out ahead on taxes.

So for example, if your total VA % is 4871.19 then you would need that same amount approved for CRSC to gross the same amount but have everything exempt from taxes.

For those who hit 20 years very few are able to come out ahead with CRSC due to this fact. So if approved for even 80% for CRSC it probably isn't worth it to make 2k less per month just because the 2k is tax free.
