Evening all,

Just wanted to share my timeline/experience with CRSC.

3DEC21: Sent application via USPS certified mail with signature receipt.
8DEC21: Arrived at CRSC Dept Ft. Knox
30DEC21: Decision letter populated digitally on Reserve/Veteran/Retiree section of HRC portal under documents page.

I medically retired in APR ‘19.

Thanks to everyone’s assistance on this forum. I read through tons of posts and took lots of notes while filling out my own application.

Decision letter was favorable in recoupment of all my earned retirement. 14 yos.

My Pay and DFAS has not yet been populated with anything new regarding backpay or monthly CRSC payment amount. Will update above timeline when I see updates/payments from DFAS.

I infer that your remark indicates that your CRSC will replace the retired pay that was reduced by the amount of VA compensation.

Your CRSC will be the lesser of:
--the longevity portion of your retired pay (example: 14 years AD x 2.5% = 35% longevity multiplier x average high three base pay = longevity portion of retired pay
OR
--the amount associated with the approved CRSC percentage (amount found in the VA compensation tables)

CRSC when combined with residual retired pay (remaining after VA offset) cannot exceed the longevity amount.

Hi Ron,

That’s what I gather. My VA Disability Pay + Waiver replaced entirety of DOD retired pay.

If my understanding and calcs. are correct, I should see 35% of high three. 90% CRSC was awarded - of which, I needed to meet 60% in order to see full “lesser” longevity amount.

If your longevity amount is less than the CRSC amount found in the VA comp tables, then it becomes the CRSC.

High three is the total of the highest 36 months of base pay, divided by 36. The result is multiplied by the longevity multiplier (which is AD or AD equivalent x 2.5% (or 2% if enrolled in the blended retirement program).

18JAN22: Decision letter arrived via USPS in mailbox.
CRSC statement on MyPay - still waiting.
 
This suggests that you will be paid CRSC on 1 Feb 22 for 1-31 Jan 22. The DFAS internal cutoff for processing documents is around the 21st each month, similar to the Service Finance Centers before DFAS existed.

Retroactive payments will be in the future.

Hello Ron,

That would be great if it pans out this way.

I called DFAS a couple of weeks ago to see if they had received my decision letter from HRC, and the associate I spoke to confirmed receipt of the document on 04JAN22 - I’ll add this to the timeline.

Appreciate your assistance and positive mindset!

Still waiting on Retro Pay - anyone have any idea how long it takes? I was thinking of calling DFAS, but have no idea what to ask them. I’ve seen other posts where veterans asked DFAS for the status of their audit; and we all know sometimes it’s not only who you speak to, but also if you ask the “right” question...

Hi all,

I called DFAS today and was told that they hadn’t started the retroactive entitlement to CRSC audit yet.

The representative suggested that I call back on 02-03MAR (30 days post initial monthly payment), as DFAS holds themselves to a 30 x day standard to start audits for retroactive entitlements.

And…at one time it took 6-12 months to receive retro CRSC.

My experience long ago. Things have changed for the better.

Indeed they have...happy to hear they’re turning them around in a timely manner compared to years past - thanks for the assistance earlier, Ron.
 
Does anyone know the status of the CRSC 6 year look back on retroactive CRSC?

An article concerning the Soto Decision is at LINK Soto Decision

An extensive search of the Internet today (2/14/2022) resulted in finding zero comments from DFAS on how they intend to process those claims affected by the Soto Decision.

I called and spoke with my contact at the national veterans legal services program that coordinated the efforts for the soto lawsuit and he stated that DFAS has a list of retirees who are collecting crsc that were effected by the illegal 6 year back pay rule and that they are tracking the issue but there is no timeline in place for when the retro pay will be processed. Of note I called DFAS to see if they were tracking the issue and they are clueless but the people I spoke with are all DFAS were customer service representatives
 
I guess everything moves in a slow methodical way especially with the government! Thanks for looking into it. As with everyone we will be watching the progress on this issue!
