I am a traditional Air Guardsman of 23+years who has been on Active Duty; Operation Iraqi Freedom orders for the last 3 1/2 yrs.
I was diagnosed with Severe Obstructive Sleep Apnea in June 2008. The Pulmonary doctor stated in a letter August 22, 2008 that it is medically necessary for me to wear the CPAP and would not be in my best health interest to discontinue the CPAP for 120 days. Which means I do not meet the Air Guard Waver of 120 days, being non deployable.
I have been on Medical Continuation (Title 10) Orders since Oct. 1st 2008. I was advised during the DTAP class that I would be Medically retired with 50% disability.
My MEB came back this Friday Feb. 20, 2009 and I was told I was being returned to duty (RTD) , would be removed from orders receiving no compensation and that I was medically disqualified from the Air Guard due to not meeting the 120 day waiver.
I was told by my PEBLO I would have to sign my MEB by Tues. Feb. 24, 2009 so that it could be sent to the Guard Bureau for my final determination and that when the final determination comes back they will take me off of Medical Continuation (Title 10) Orders.
My questions are, since my MEB came back with the determination to be RTD, and I will lose my ability to be on any Active Duty Orders and I am not waiver able to stay in Air Guard what will happen next? The Air Guard will release me and I will have no Title 10 compensation? Do I sign the MEB on Tuesday? Do I reject the MEB?
