Discrepancy On Findings.

My findings came back unfavorable. 20% DoD and 60% VA. My lawyer obviously suggested I now proceed to the Formal Board Process. In his review of my findings, regardless of only getting 20% DoD, in a comments section it said "TDRL as symptoms may change" also it stated my condition may be permanent. With this being said, could this just be a simple mistake and I was meant to be retired vs. separated w/ severance and would I really need to go about a formal board just for this? Any other avenues I can take? I'm pretty sure your not put on TDRL if your separated w/ severance right?? Any Insight would be highly appreciated.

That is correct. If you are placed on TDRL or PDRL, you do not receive severance. *Someone could receive disability severance and, after separating from service, appeal and be awarded medical retirement. In that situation the veteran would receive both placement on TDRL or PDRL and severance, but severance would be paid back. That is not your present situation.

Are you in contact with counsel for your FPEB? They may be able to submit a request for reconsideration prior to the FPEB.
 
Thanks for the reply! Still no contact w/ counsel. I am waiting for a FPEB date and to find out who is appointed to me. Is the idea of my attorney requesting a reconsideration a real possibility? If so that would be awesome because honestly idk how much more evidence I can gather for my case.
