Do I qualify for ABCMR and CRSC?

I did about 8 years of service, 4 years active and 4 national guard. When I got out of Active duty I applied for VA disability and was granted 80% then later given 100% P&T TDIU
I notified the National Guard so that they could send me to through the MEB, but my superiors did not want to. I kept drilling like normal and just got counseled with DA Form 4856 saying I was unfit, but nothing else was done and I was(and still am) clueless of the process.

I pushed and pushed and eventually contacted IG because nothing was being done, and I was about to ETS. They contacted my superiors and I guess they let them have it(because I later got yelled at too), and they gave me an "uncharacterized" (Y) which is administrative separation.

That was in 2016 and I haven't done anything since, because my superiors told me I would never be able to get any other benefits(besides VA) and I believed it. Now i'm starting to read into it again and it's looking like I may be eligible for ABCMR and CRDSC but where do I start? I've had bad luck with VSO's since the one I had told me I'd never get 100% and I had to go it alone.

If you are not in a retired status (traditional, medical, etc) then you would not be eligible for CRSC.
As far as ABCMR, you could always try. But that was almost 10 years ago. The chances of them going back to change your separation to a medical retirement, especially if the army didn't put you through any form of Disability Evaluation System (formal or informal), are probably 0%.

I already submitted a packet with everything I had included. Luckily I kept all my documents and have my DA form 4856 where they kept counseling me that I was "unfit" yet they never pushed me through to the board. I have the paperwork showing my original 100%VA date, which was before I separated. I also have the email I sent to IG asking for help on the matter. I also attached my C-File. It's been about two weeks since they received the packet, so I'll update here when I get a decision. If I don't get approved, i'll likely hire an attorney, not sure how much good it'll do, but I have all the evidence that they should have pushed me through to med board and didn't despite me even asking IG.

So if you'd have been separated with a P3 profile, and documentation that said "pending MEB/PEB" and they separated you anyway, I'd say you have a shot. Unfortunately, based on your specific situation as you've described, coupled with the significant time gap, I tend to agree with @d001. I'd say your chances are near 0% for a successful ABCMR, and any lawyer that took your case would likely require money up front because the chances of success are slim.

Here's the thing, you separated from active duty, joined the guard, and immediately expected them to MEB you. That's not really how it works. Given the situation you were in, you likely had multiple opportunities during your annual PHAs (Periodic Health Assessment) to get the ball rolling on a P3 profile. You don't just show up to a unit and expect your immediate superiors to MEB you. They don't know how to do that, they don't care, they just see someone show up without having contributed anything at all to the unit, and see that person trying to get out for whatever reason. It's the medical section that handles all of that. Just because you were 80%/100%TDIU doesn't mean that any of those conditions were for things that would preclude you from conducting your military duties either. That's what the P3 profile is for, which is what leads to the MEB. You got off active duty without a P3 profile, and apparently never got one in the guard.

Sorry this is probably not what you wanted to hear. Best of luck if you decide to try.
