Finally got my package

Got the package from PEBLO today and I had a few questions that I assumed you guys could probably help with.

They have me listed as 80% DoD with both my hips at 10% stable a piece and my PTSD listed as unstable at 70% putting me on the TDRL. With that my understanding is that they will need to reevaluate my PTSD at some point but that as long as that doesn't drop to below 10% then I should still be at the minimum of 30% to go to the PRDL. Is that understanding correct?

Additionally they claimed that my PTSD was from childhood trauma and that getting shot at by missiles on a ship that was operating in the Red Sea just exasperated that issue and that my PTSD was not combat related. That being said is this something I should fight or will it really matter. I do have a Combat Action Ribbon as well so not sure if that matters. I think @RonG pointed out that I did not need to file for CRSC since I am over 20 and would just get concurrent so also not sure how that plays into things.

Really just want to make sure that I do the right thing and if I should fight I will but if it makes no difference then that is fine as well.

Additionally I was given 100% VA P&T. Even removing the 70% PTSD wouldn't change that as sadly I am very broken.

That does not sound like something I said. Perhaps, I told you that you already qualified for CRDP (taxable). If you applied for CRSC (non-taxable) and it was approved, you would receive the lesser of:

--longevity portion of retired pay
OR
--the amount associated with the approved percentage of CRSC. The VA comp tables are used for the amount.

CRSC is less than CRDP in some cases.
CRDP is never less than CRSC and often it is more..

If you have over 20 years active duty none of this matter near as much for you since you will have your regular retirement and VA compensation via CRDP if your PTSD is lowered at the end.
 
@RonG Yes I apologize was just going off of memory and didn't go back to read the response that you sent previously but I had looked after I posted I should have clarified that. Based on the info though is it worth me asking for a formal board to try and get the combat portion fixed or is it really not worth it. I am kinda over the hurry up and wait thing. A friend of mine told me I could fight the combat portion later but I did not know if that was the case and didn't want to operate off of the wrong information.

@Provis So in essence worse case is that I would drop from 75% and go to the 52.5% since I will be at 21 years?

Yes and since your maxed out with CRDP you don't lose anything. When you get 75% DOD which is higher than your longevity your VA compensation restored through CRDP is less. So your maxed our on compensation regardless of whether you rely on your DOD% or your longevity from your regular retirement.

its sad, im assuming they plloked at your service record and I know that was in your eval. I know the are you were in and the CAR is the proof. You know I remember being downrange with fleet guys on IAs and their commands would give them such a hard time about CARs. and dont get me started on Bronze stars....I see Army gys on the fob get that for paperwork. Anyway good luck on your future. I got mine back today Ive been in 29 years active and I got 100 VA and 70 DOD. now i guess i wait for orders or something
 
@SDV_PILOT They basically decided because I was in foster care most of my life that was the start of my PTSD even though I had completed almost 15 years and 2 other deployments with no issues before the incident that prompted it. Kinda messed up if you ask me.
