Good evening all. Hoping to gain some insight/guidance on the best way forward. I received my initial proposed ratings: 40% DOD /100% VA. I’ve been in contact with my legal representative and he’s been extremely helpful. i decided to appeal for 2 reasons: 1) add 1 unfitting condition and 2) get the current unfit condition coded as combat.
We submitted the rebuttal last week (included buddy statements, personal statement, profile, doctor notes, MRI, etc). *We did complete an IMR at the MEB phase but nothing changed. I received the formal board notification with a date in June.
My question is: Is there any chance the formal board could review the file before the board? I’ve seen others mention it happening in an indirect way, so just wanted to ask. The truth is, I know the second condition is unfit but Im weighing whether it is worth the wait to fight for the formal board or just accept now and move on with life. I’m very thankful for how quick the process has gone (compared to others) but I don’t think I can stomach pushing the date almost 4 months right when I’m trying to make plans for my family and moving.
