Formal Board Notification

Good evening all. Hoping to gain some insight/guidance on the best way forward. I received my initial proposed ratings: 40% DOD /100% VA. I’ve been in contact with my legal representative and he’s been extremely helpful. i decided to appeal for 2 reasons: 1) add 1 unfitting condition and 2) get the current unfit condition coded as combat.

We submitted the rebuttal last week (included buddy statements, personal statement, profile, doctor notes, MRI, etc). *We did complete an IMR at the MEB phase but nothing changed. I received the formal board notification with a date in June.

My question is: Is there any chance the formal board could review the file before the board? I’ve seen others mention it happening in an indirect way, so just wanted to ask. The truth is, I know the second condition is unfit but Im weighing whether it is worth the wait to fight for the formal board or just accept now and move on with life. I’m very thankful for how quick the process has gone (compared to others) but I don’t think I can stomach pushing the date almost 4 months right when I’m trying to make plans for my family and moving.

Thank you! Look forward to any notes anyone can share that’s been through this on the Army side.

Am in the same boat, my Formal date is April 13th, applied on Jan12, so its like 3 months wait to get a Formal date. I am at 20% DOD, so i really need it.

So you can sometimes get it changed before the FPEB. Have legal help you write up a informal request to the FPEB before the board starts. Sometimes they review it and agree and you get sent an updated DA199 with requested changes without needing to get to the FPEB. It all depends on how strong your case is. If its a no brainer they make the changes and it saves them time with one less FPEB to do.

That’s great insight and extremely helpful. Thank you! I signed the formal peb notification letter today…hoping for the best. Legal completed the rebuttal when I requested the FPEB so fingers crossed.

It happened just as you described! Two weeks to the day I got a notice that they did an Informal review of the FPEB w/ associated documents I submitted and accepted my rebuttal. You called it
