I finally got on my ebenefits for the first time since I got out of the military, 2 years ago this month.

"Under details of your claim"- it has all of my claims but also non-service connected pension, individual unemployment.

And it also lists my estimated claim completion date as: 09/24/2014 to 04/14/2015.

I don't know what is going on. I'm in tears. I don't have a non-service connected pension, I was denied SSDI. I did not apply for IU, and I don't know why it is going to take a year and a half to complete my claim when I finished my C&Ps last week and I have been waiting two years already, had my MEB in July of 2011, and I medically retired at 60%. Please help me.
 
I'm going to have a freakin cow! Are they ALL morons?

I've been calling monthly and repeatedly told I do not need to send anything, that they have all the information they need.

THEY HAVE ALL MY RECORDS, TESTS, REPORTS, VA VISITS. What the hell do they need from me and when I call, why do they keep telling me they don't need any information.

Why the HELL is it going to take 3.5 years to complete. I was medicially retired!!! You all are idiots and there shouldn't be a government freeze, they should fire you all and start from scratch.

I hate this, I hate them. They don't do ANYTHING right and should have inspections repeatedly, and they would fail and get fired.

Can I find out who my VSR is and have them evaluated and get them fired? They have started my claim May of last year and stated I did not send in neccessary evidence by August. They are morons.

Amy, I hope some mistake. Maybe the estimated time to complete is purposely low balled? Could it be just a standard reply for the timeline?
 
IDK. Do they Actually READ any of our records? Because I know the doctors that preformed the C&Ps didn't and looking at my ebene, it looks like they don't know how to read my medical records either. Or even know i was in the military, let alone medically retired. I'm not in the military anymore, can I sue them for negligence? What is a section 1151 claim?

Now definitely starting that Congressional inquiry. I didn't in August because my C&Ps were finally made. But the VA seems to not be able to read 11 years of MILITARY medical records from since I was 17 and find the neccessary information, because it looks like they waiited for me for 15 months for the information they already had in hand.

It just looks like a big set up for a denial and makinging me wait another 19 months is totally unacceptable when I sent them EVERYTHING needed in September of 2011.

A total of 43 months in UNACCEPTABLE, for someone who was medically retired. Especially when they are lying with their "18 months" quote over and over. They said they were completing claims that were over 24 months. Failed to mention the completion would take just as long. They don't give a sh*t about those who served. All they have managed to do is make my depression, anxiety worse. Make me financially unstable, have my car reposessed, I had to sell all my belongings, Made my medical condition worse by changing all my meds and canceling numerous appointments. Trying to work but making my health worse. Billed me for the first year getting treatment for my service connected conditions. Need the money to live, but watch them ding my for working part-time. I hate them. I hate them.
 
I wish I could answer your questions but if you remember I said they screwed me over as well. They claimed some of mine existed prior to service, they marked the info for the wrong arm ...I would contact your Congressman tomorrow morning. I sent my Congressman an e-mail Tuesday and was called by his assistant Wednesday about the screwed up C&P exams the last two weeks so I'm thinking they do have some people working. I will give you his e-mail if you like. I know how you feel because I definitely feel the same and I'm not nearly as bad off as you.

I'm hoping Jason will respond as well.
 
Side note, if they want to give you IU, I would take it and continue to fight for the correct amounts.

It said my date to provide evidence for my IU is suspended, but I did not apply and it did not state which condition it was for.

We retired and had our C&P around the same time and are both processing through Ohio. Is your projected date as bad as mine?
 
I got out one month after you, your info guided me every inch of the way. I can't remember when but I called the 800 number and they told me to contact my Congressman. Although I didn't want to; I contact him and my case was rushed through (financial issues) and I assumed (gasp) that all the mistakes were because of it. My case was finalized 10 Aug 2012 but the kept one item open and that is still going with a completion date of 15 Apr 2014 til 7 Sept 2014. Mine also was at Winston-Salem but now is at Cleveland.

I thought we were in the same Congressional Districts but I am in 10th and Columbus is in the 3rd. I looked up your Senator and they are Sherrod Brown (D) who has posted that he is closed until further notice and Robert Portman (R) who appears to be open for business. Your Congress Woman is Joyce Beatty (D), don't know if they are working. I'm going to leave this but I'll send you a private message.

Hey Amy, I have a temp 100% UI in they received it last week and it stated the exact same timeline.

How were you notified of a temp IU?

My ebenefits changed on Thursday this week to a completion date to 8 Sept 2014 to 24 May 2015 and changed "Pending Decision Approval" to "Gathering Evidence" and it's in an orange color. I clicked on the "view required evidence" link and it indicates they need recent documentation on two of my conditions--which I am still undergoing treatment for.
I would understand how they would need documents if I was not going through MEB/PEB process and I wasn't providing info--but for every month since last year, I've requested a copy of my medical documentation-VA and outside, 2nd opinion docs and I've provided them to my PCM at the VA, the MSC in Nashville and my PEBLO every month. I contacted state DVA. It appeared he was only reading what the screens were saying and didn't have a clue as to what I was talking about. He told me I would be getting a letter in the mail from Seattle. I did--but it was basically the same letter I got 2-4 months ago saying they were still working on things.

I too get seen monthly by the VA. They have ALL my medical records and still need to gather or "find" information? They just don't read the records like they are supposed to.

When is your start date? We have the same projsected date and I initiated my VA claim in Sept 2011.

I don't have any way to give a definitive answer- the timing of claims are one of the more inscrutable pieces of the VA system (in individual cases...in the aggregate, you can get averages that may be helpful, but in individual cases, there is a great variation). That said, I would not necessarily place much stock into e-benefits. It suffers from the same problem as most computer systems- it t is "garbage in/garbage out." If bad info if input, you will get bad info as an output.

Seems to me that if your C&P exams were completed in August, that is a significant fact that bodes well for a speedier resolution.

(Though, it is strikes me as odd that they have not made any rating decisions in the time you have been out. I would have thought that given the time that has passed, they would have made a decision on some of your claims and deferred other issues that they could not rate based on what evidence they had. Makes me suspect that they did not have access to or it took a long time for them to get your military medical records. That is just a guess, though).

Need some more information to try to figure out if there are some issues that have slowed your claims.

Did you file a claim immediately after you retired from the military? When did you file?
Did you move to different states since you retired (if so, how many times)?
Did you submit more than one claim at different times?
Have you been submitting evidence over time (for example, receiving one piece of evidence- like a doctors report, submitting that, and then submitting another report at a later time)?

As far as SSDI, if you are not working because of your disabilities, have you appealed the denial? Seems to me, from what I have read in your posts, you should have a solid basis for an appeal.

As far as the IU, if the exams, evidence, or your claims suggest that IU might be appropriate, the VA is required to make a determination on this issue, even if you do not specifically claim or request it.

Congressionals (like submitting new evidence) can slow things down sometime. I would just be aware of that.

I have a number at the VA that may help you. I don't have access to it right now, but I will post it once I am able to.

It started in 2009 where I got ratings and currently get compensated from that. In 2012, I requested changes for some conditions since conditions/symptoms deteriorated. Following another C&P in March of 2012, I got letter saying there would be no changes and that I could file an appeal. Several months later, I was notified of unfitness--so I didn't file an appeal because I knew I would have another C&P pending MEB/PEB status-October 2012. Per the MEB/PEB process, I was scheduled for C&P in February 2013--NARSUM received March--appeal sent the end of April--went to PEB on 6 May. In July, I contacted PEBLO for unfit memo; which I received; it was dated 6 May-so it's been in Seattle since 10 May or so. Upon contacting the state DVA two times, they both mentioned that LA and Houston cases over a year were sent to Seattle and that those cases would take precedence.

I applied for it due to surgery on my foot which is a rated claim. I'll be applying again for temp UI in about 5 months for my other foot.
 
Again, you applied for it. I did not and it is stating I did and asking for more evidence, that it is too late and I don't know why it has it because I did not apply yet, due to not having a rating AT ALL and it was started and closed before my C&P and I did NOT do it.
