IRR members right to request a PEB

There is another recent thread on this subject, but here mine is a little different. I was recalled in 2003 for Iraq and was IRR USMC and was injured 2001-2002 in Afghanistan/combat. While I was being treated, and just undergone surgery for my back/paralysis in the IRR (2003) they only sent to me an Honorable Discharge certificate, (I had orders and was placed in active duty-I sent them medical docs) they never gave me the right for a medical board (they did not follow SECNAV at all)-which I would have pursued retirement. I have a standing case, I am ready to appeal at BCNR which wasn't included form the prior, so it will be new evidence. It should be noted that my medical LTB on active was canceled without a board b/c my command didn't want to accept responsibly for my injuries and SWATO exposures-so the physician did it on his own willful neglect. What are my rights here, anybody, and please be detailed. BTW I did not mean to steal the thread name-it just fits perfectly. Ultimately, I am seeking PDRL and CRSC.
 
I doubt you'll get PDRL and CRSC, you're no longer in.

You were activated for a said period of time from the IRR.

I assume from a Reserve Unit from whatever state your Home of record was on your 214.

How long were you in for? Total time?

I retired Air Force and can't remember the Marines regs but there's probably a said period of time you need "example... 10 or more years" to be considered to be medically retired. Less than that they would give you a one time severance" that's an example. I don't know off hand the years needed for the USMC.

What caused you to wait 13 years to fight this?

Do you get Va benefits now?


This is like a Vietnam Vet That was shot in the leg, got his ticket home, was discharged, and want the same thing. Stop me if I'm wrong here....

There's a lot out there. I know one that was shot 2x in the hip. Does he have the same right to try and get PDRL & CRSC? I don't know. Or have a clue.

I personally "think" you'll be pissing in the wind for years. There's hundreds of thousands that were active duty that got injured and are out now that are in the same boat. That's combat and non combat injuries.

The government ain't going to open that can of worms. That was a battle you should of fought WHILE you were in. I Have a feeling you'll end up filing a claim and get what the Va gives you and that will be the end of it. If you haven't done that already

If you were separated for a medical condition between 9/11/01 and 12/31/09 you can apply to the PDBR to have them review your medical discharge and see if you were rated improperly and possibly be granted a retro active medical retirement.
