Just got notified of Admin Sep by Command, already found unfit by PEB.

My case is currently at the Chief of Naval Personnel’s office, does anyone have any experience with how long it would take them to come back with a decision?

No, since the new policy went into effect to my recollection we haven't had anyone fall under it. Interesting to see how this plays out.

Don’t know what to do. I’ve never had any disciplinary action the 3 years I’ve been in the Navy. I go Limdu and start a MedBoard, and everything goes to shit. I went to DRB and XOI, but after consulting with Legal was told by 3 different attorneys to request a court martial because everything the Command was accusing me of was either an outright lie, or extremely exaggerated.
This was about 5 months ago. My Command just called me in saying “we need you to sign an Eval”, and when I got there, presented me with admin sep paperwork out of the blue.
I already know my rating because I called the VA and had it faxed over to me. 90%. Just waiting on my PEBLO to call me in and sign everything. Literally almost done and out of the Navy and they drop this on me.
Went and talked with an attorney at DSO, and they said it was bullshit and are seeing what they can do. Also went and talked to the IDES attorney I’m assigned to, and she was furious and couldn’t believe it.
The main thing I’m claiming is PTSD. I literally can’t do this anymore, I’ve fought with this Command for almost 6 months now. I can’t go back to that Command. Been investigated by NCIS because someone left anonymous tips on their website saying I was “going to be an active shooter”. The original charge sheet they presented me with, after I requested Court Martial, the CO dropped all the charges. Then 5 minutes later had another charge sheet with a bunch of new charges.
Feel like I’m living a fucking nightmare. I’m going to the IG route tomorrow morning when they open. Any advice is greatly appreciated.
10 U.S. Code § 1219 and you have the right to your counsel, don't let a command bully you around. I was forced to sign a document under duress. A lot of the stuff your going through I went through. I made IG contact and we all know how that goes, the next higher than the unit commander to investigate and the $h!t roles downhill on you. Are you a combat vet? How i your PTSD connected? You'd have to move on that as fact finding. Your not entirely clear here. So, I am not sure I can relate all the way as I was forced into silence from combat ops by CO. covering up his wrongs. You have JAG, but I'd advise outside civilian legal counsel and see what they say. They tried tricking e into an Admin Sep if they couldn't get me a bad paper. This was after four years of hell and combat with loads of injuries and a GCM and no negative admin papers.

Please explain more or PM me. I would hate to think you are in a similar situation I was in and things were different several years back, VA would in turn screw you over afterwards. I've been through muck.
