Lawyers

I got my IPEB results on Friday 19 Nov 2010. I walked out of the hospital and called the AF lawyers that I had been referenced to. I got an email on Monday from them asking for a copy of my 356.

Interesting to know that they have 4 lawyers working, taking care of AF active duty, guard and reserve. They have to be overworked. I was told that someone would review the form and get back to me in regards to a decision to appeal or not.

They also said that they are very busy, and I may only get and email from them.
If I do not hear from them by the time I need to respond to the IPEB results, I can request an extension.

And of course, as I have seen on previous posts, if I do indeed decide to applea, I will not meet my lawyer until 3 days before my board. It is going to be interesting to see how his pans out. Any bets on what their suggestions will be regarding appeal?

I'd have to ask what experience another Air Force person has had using the Air Force Lawyers. My experience was not good as my first response back from them (paralegal) was full of misrepresentation of facts to the point it irked Jason, the forum administrator. I opted for a personal attorney who was also able to help educate me along the way while building my case for appeal. It turned out to be worthwhile since my ratings went from 40% to 70%. Had I trusted the AF attorneys at the time, I doubt little would have changed in my rating.

Did your letter come from an actual attorney or paralegal?

My email, came from a paralegal. They basically wanted a copy of my 356, and some generic information like time of service, job, deployment potential etc...

I replied back to them immediately, still have not heard anything from them. It is still amazing to me that there are only 4 lawyers to serve appeals for active duty, reserve and guard. Those folks must be swamped, overworked. It certainly causes concern over the quality of legal care one would receive.

They are swamped. But even if they where not, you do not have a specific attorney assigned to you until 2-3 days before your board. given scheduling there is not gaurantee you will be able to have enough time to familiarize that lawyer with your case.

I have given up on it and am going to pay for private attorneys of my own. I still get a Jag attorney and will have a private attorney who can help me at all times before during and after. I am still in process of deciding what specific attorneys I am going to hire.

Oh and FYI, you can not file an extension AFTER the time period has lapsed. I am in the exact same situation right now but for Army. My board was on the 17th of Nov, and I received the results on the 19th. Monday is the last day according to my peblo to turn in my form. I was advised by a military attorney I was able to get ahold of to elect for a formal board to BUY MORE TIME. I can change my decision on a formal board at anytime before the formal board begins. That is what I was told anyway it may or may not be true.

Downside to the whole thing is private attorneys cost money, I am planning on this process costing me out of pocket upfront before the FPEB at least 8k, and likely as much as 16k. But **** it I am going for a 100% rating same as I got from VA and same as I got for social security for the same unfiting condition they are rating.

I was in middle of a psychiatric appointment when I got my first call back from the office of soldiers console. The Maj. who called me said I was being argumentative and basicly threatend me and remind me he was a Maj. saying he had other things to do and I should be thankful he called me back the day before thanksgiving. Of course I was upset I finally get a call back, and I am in the middle of intensive re-exposure therapy when he says this is the only time he can talk to me before monday when my decision is due.

anyway Best of luck with your case. I hope everything works out for you.
