NARSUM IMR to request to add potentially unfitting

Hello,

I have read many posts, but this is my first time posting. My referred condition is for “left arm pain”. I was briefed by my PEBLO today on the MEB results and have to make an election next week. I have had two shoulder surgeries, ulnar nerve relocation, cervial radiculopathy, cervical disc arthoplasty, and arthritis in my hand. All of which I still have complications, take medication for, and attend PT. I do not understand if “left arm pain” accurately reflects all of the conditions I have or if my left shoulder pain/ROM due to my injury and surgeries would be the only thing considered. I know that it does not reflect my neck, but my PEBLO just keeps saying “it’s your whole left arm”. I understand they are not my advocate or expert. All of the conditions are mentioned in my NARSUM and CC statement, but i would like to submit an IMR to ensure all of my potentially unfitting conditions are considered. Does anyone have any advice or templates on what to submit? I have contacted ODC and have been assigned a lawyer but I am currently waiting to hear back. Thank you very much for your time.

I’m on the same boat bro. Got my NARSUM today, looks good but they’re missing some conditions.

Btw OSC-counsel is non-existent right now, buddy and I are at the same stage..he contacted soldier counsel last week and hasn’t heard a peep, PEBLO and MEB are pushing toward a decision. MEB@camp atterbury and fort Eisenhower

I hope it can get resolved for you
Not sure if you know this but you can choose to have a private attorney represent you instead of relying on JAG where that person is swamped with cases. That is what my wife did. I will send you some options. There are only a handful that specialize in representing IDES clients. Hiring a private dedicated attorney isn't cheap but may be worth it for you. I know in my wife's situation there is no way in hell she would have gotten as good of a result with her assigned JAG having seen the difference between the 2 in both effort and strategy.

@Provis is right. Knowing the strategic use of the different mechanisms in the MEB process is key. If you are dead set on doing things yourself while waiting on government counsel, make sure you read up on your Service's IDES order. They don't give practical insight or templates, but at least you'll know the purpose behind the processes and mechanisms, along with the players involved - IMR doctor, MEB convening authority, etc.

S/f,

Joel

Disclosure: I was a Marine JAG, Active Duty and Reserve IPEB & FPEB attorney, federal government civilian FPEB & TDRL-focused attorney at the Navy PEB, and now a private attorney focused solely on IDES cases. This post is meant as procedural insight only and should not be construed as legal advice related to a specific case or a legal analysis of facts thereof.

I am interested in the attorneys that you recommend. I am starting this ides process and don't have a lot of confidence in my assigned case worker.

I'll send some to you now via direct message
