Navy MEB/ PEB, is my process correct?

Hello,

I am in the Navy currently and been being seen for over a year for by back. I have read up on some info I was able to find here. I feel I understand the process and how it all works. My question is, is the DODI 1332.38 enclosure 4 still relevant? In there I notice some of my back conditions that are suppose to be recommend to the DES. This has not happened and nothing has helped my back as of yet. Should I shed already been in the DES system with spondylosis? I have many other things that make.it very hard to do my job as MA including spinal stenosis 2 herniated discs, some type of arthritis fusion I can.not recall the name right this second as well as knee instability and patellafemoral knee syndrome. Any advice will be appreciated thank you!
 
Generally you're allowed 2 LIMDU periods, six months each before a MEB is started.

So if you've never been on LIMDU I'd say a MEB is very unlikely now. If treatment fails in the next year a MEB would be likely at that point.
 
Ok thank you, cause when I was reading the LIMDU instruction it was saying a second period is only if they disability is able to be considered fit in the foreseeable future. So with mine that is never gonna get better only worse they say, would this allow the first and then start the MED board?
 
I was only on LIMDU once before i was referred to MEB. I'm on my second LIMDU while I await my findings. But typically, depending on the condition a second LIMDU is not necessary.

O ok that's good to hear. Because all the docs keep saying it will not get better, only worse and everything they are doing is just to help with pain. And i read something saying a second LIMDU is only if they see you getting better. Thanks for the info. Are they giving you a time frame for how long everything takes?
 
I'm a Marine being seen at the Naval Hosp. My Dr. placed me on my first period of limited duty in April of this year and started my MEB in Late May. Apparently she believes I will never be well enough to continue on as a field grade officer...I agree.

Yeah my doctor said typically 6-9 months... he said that they were getting pretty quick with everything for awhile... and it was taking 3-6 months for things but recently he's noticed that they started slowing down again. And that's from the time they start the MEB all the way till you get your ratings back from the VA. Obviously there's a few more steps inbetween but for active duty Navy that's what I was told... Timeline will probably vary based on your diagnoses and what you're trying to claim with the VA.

Thank you Pennyfarm, that's what I've been getting told that my condition wont stabilize they can only try to help daily pain.

O ok that's not to bad. So they don't start doing the board until the VA ratings are back then? I assume because they also use the VASARD or whatever ratings so they will base their determination off of the VAs then.

Actually how it works is you're up for the Medical Evaluation Board... that's when the board process starts... there you'll gather all the evidence you need for your case, including a letter from your command called the non-medical assessment (NMA), and your narrative summary (NARSUM) which. The evaluation appointments with the VA will be scheduled which they will evaluate you on the condition you're going to the MEB for, including all the conditions you're going to claim with the VA that you've been seen before throughout your naval career.... a few weeks after those appointments are completed your PEBLO will receive the results from the VA and all the other documentation you'll need for your package and you'll review and sign them (you can have a lawyer look over your stuff if you want first, It's up to you) Then your package is sent up to the Physical Evaluation Board where they'll determine whether you're found FIT/UNFIT to continue your service... from there your case will either end there if you're found FIT or continue on if you're UNFIT... that's when your package will be sent to the VA for your ratings.... and then when you get your ratings back it can be reviewed and signed by you.... then you'll usually get discharged within 3 months of that... but again, it all depends on a bunch of different things... like whether you agree with the findings... cause if you don't you can go to a formal board and try and appeal things... which obviously prolongs things... so honestly it just depends on your case and how quickly you get things done on your end. Lastly you'll get two ratings if you are found UNFIT... one from DOD and one from VA... the DOD rating will be JUST for your unfitting condition... all this will be explained in detail once you go to DTAP class once you start the MEB process..

Wow, thank you that is about as detailed as it gets lol. I really appreciate the info. Im pretty sure they can file my back knees and nerve issue for the MEB considering they all hand in hand interfere with being an MA. Well hopefully all happens soon. Right now I got my final LLD chit which puts me over the 90 days. My Dr wanted to wait until we see how I react to the steroid shots before discussing LIMDU.
