I am currently active duty E4 with 8 years. My doctor put me on Medical Board as of 14JAN2010. On 14JAN2010 I met with Medical Board Caseworker and inform him I am High year Tenure (HYT). Medical Board Caseworker ensured me the process should be completed before 14MAY2010 my EAOS (HYT date) and if the Medical Board process goes longer than it should then I will get a 3 month extension until you get results back from Washington. Medical Board Caseworker gave me a written document explaining I am on Medical Board to give to PSD. 14MAY2010 I got my 3 month extension from PSD.
08JUN2010 Command Career Counselor (CCC) also the LIMDU coordinator mentioned to me that my non medical assessment (NMA) arrived at his desk. CCC said he will be holding the document until he gets additional information (He mentioned that he is on my side) and a possibility I will be exiting out of the Navy within 10-30 days worse case scenario. CCC did mention the doctor should have no placed me on Medical Board since I am HYT. Confused about the whole situation I went to back to Balboa Hospital in San Diego to confront my Medical Board Caseworker about me getting out of the Navy. Medical Board Caseworker asked if I had sent the message to PSD and I ensure I personal gave the letter to the PSD representative and it is how I got my 3 month extension.
I decide to speak with a Jag Lawyer at the Hospital explained my situation. The lawyer said actually I should be out of the Navy and surprised I managed to get the extension. The Jag lawyer said the CCC shouldn’t be holding a medical document and the document should’ve been done a long time ago. The Jag did mention to me the Medical Board packet should’ve been sent off before 14MAY2010 and if I gone through the Jag the packet would be done. The Jag sent me back to the command to have the CCC call her. I went back to the command and explained to the Chief the Jag wanted to talk. CCC refuses to call the Jag and said he doesn’t need to talk to the Jag. I mentioned the Jag will provide the additional information you need but still refused. I call the Jag and told everything I had discussed with the CCC. I gave the duty number to the Jag and the Jag called CCC. I called the Jag and the Jag the paper should be done by the end of the week.

b. Limited Duty (LIMDU) Status. Personnel in a LIMDU status and approaching mandatory HYT retirement, mandatory HYT transfer to the Fleet Reserve, or mandatory HYT separation will only be retained on active duty if actually hospitalized as an in-patient, or if their case has been accepted by the Physical Evaluation Board (PEB) for disability determination. Being seen as an outpatient or submitting a case to PEB(without it having been accepted) is not sufficient justification to retain members beyond their established HYT date.
During the whole situation triggered my PTSD.
Right now, I don’t know what to do because I think I am exiting out of the Navy 14AUG2010 and my Medical Board Packet was sent 12JUL2010. I don’t know what to do in this situation because I did everything I am suppose to do but my command held up my NMA which prevented the Medical Board from being sent. Can anyone provide any information on what I can do??? I feel I cannot trust these people. During this process I feel I was misinformed.
