of medical conditions determined unfitting for service, I received 70% of which 30% is combat related

VA Disability
of total medical conditions evaluated, I received VA rating 100% Permenant & Total

PEBLO stated that I should receive CRDP (52.5% of base pay + 100% VA disability)

Should I apply for CRSC or stick with CRDP, or can I get both?
 
Hello @SFH

1. CRDP is for all service-connected disabilities and requires a 50% VA rating or more.
2, CRSC is only for combat-related disabilities and is usually the lesser of the
--longevity portion of retired pay
OR
--The approved CRSC percent amount found in VA comp tables.
3. You can apply for CRSC and if the approval is less than CRDP, DFAS will pay the higher of the two.
4. You will receive only one or the other.
5. I assume from your comments that you qualify for a regular retirement with 20 years AD or more.

6. The combination of residual retired pay and CRSC or CRDP cannot exceed the longevity portion of retired pay. I did not audit the amounts you cited.

Since one unfitting condition is combat related your entire chapter 61 pension is exempt from federal income taxes meaning there is no scenario where you will come ahead with CRSC since you will get everything between your longevity retirement + VA Disability compensation and all of it will be exempt from federal income taxes.
 
Sent my package forward to start my retirement process. Took the clinic 4 months to write the narrative summary and one month for NGB to kick my package back stating That not only am I fit for duty but also fit to deploy. How is that even possible when I’m 3 months post op from a total knee replacement. I’m still not even back to work and dealing with continued swelling. Some days I can hardly walk but according to NGB I’m deployable. Who makes these decisions?

NG makes those decisions. The NG is often very shady. Any thoughts @tony292 @Hawaii5-0 ?
 
Is there some form of legal council I can hire to investigate NGB's decision? It's like they didn't even read the package.

You either need to push yourself or hire a private attorney. The NGB is super shady. They often don't follow the law.
